Overview

The Christmas Island Casino Control Regulations 1993 No. 1, enacted under the Casino Control Ordinance 1988, were introduced to establish regulatory frameworks specific to the operation of casinos on Christmas Island. This legislative instrument was created to address the need for detailed controls and licensing requirements for casino employees, ensuring that casino operations adhere to established standards and contribute to the orderly governance of gaming activities on the island. The regulations were made by Roslyn Joan Kelly, the Minister for the Environment, Sport and Territories, and aim to ensure that the licensing of key and operations employees is conducted in a manner that upholds the integrity and safety of casino operations on Christmas Island. These regulations set out the fees for the grant or renewal of casino employee licenses, reflecting the policy objective of maintaining a regulated environment while supporting the local economy and ensuring public safety.

Scope and Application

The Christmas Island Casino Control Regulations 1993, enacted under the Casino Control Ordinance 1988, apply to all individuals and entities involved in the operation of casinos on Christmas Island, specifically regulating the fees associated with the grant or renewal of casino employee licenses. These Regulations are designed to govern the conduct of casino employees, setting forth the necessary licensing requirements and financial obligations for those seeking to work in this sector. The regulations apply to persons who are employees of casinos on Christmas Island, including both key employees and operations employees, and are intended to ensure that these individuals meet certain standards and criteria as set out in the overarching Casino Control Ordinance 1988. There are no exclusions or exemptions specified within these Regulations, and they apply nationally across the Territory of Christmas Island. The application of these Regulations may be further extended or modified through subordinate instruments, as permitted under the parent Ordinance.

Key Provisions

The Christmas Island Casino Control Regulations 1993 No. 1 set out specific provisions governing the casino industry on Christmas Island, operating under the Casino Control Ordinance 1988. The primary sections of these regulations outline the fees associated with the granting or renewal of casino employee licences (Regulation 2). Specifically, Regulation 2(1) states that the fee for a key employee’s licence is set at $375.00, while Regulation 2(2) specifies that the fee for an operations employee’s licence is $125.00. These fees are prescribed for the purposes outlined in subparagraph 95(1)(d)(i) of the Casino Control Ordinance 1988. These regulations impose clear financial obligations on the parties involved in the casino industry on Christmas Island. Casino operators and employees must adhere to the specified fees when applying for or renewing casino employee licences. This includes both key employees, who are typically those in managerial or supervisory roles, and operations employees, who perform other functions within the casino. Ensuring compliance with these fees is essential for maintaining the validity of licences and continued operation within the regulated casino environment. Failure to comply with the financial requirements set forth in the Christmas Island Casino Control Regulations 1993 No. 1 may result in legal consequences. Although specific penalties for non-payment or underpayment of fees are not detailed in the provided excerpt, breaches of regulatory requirements under the Casino Control Ordinance 1988 could lead to sanctions such as fines or other penalties as stipulated by the Ordinance. It is crucial for casino operators and employees to adhere strictly to these regulations to avoid any potential legal ramifications.
