This Declaration is the Charter of the United Nations Act 1945 Listing Declaration (No. 6) 2016.

2 Commencement

This Declaration commences upon signature.

3  Persons, entities and assets

For section 15A of the Charter of the United Nations Act 1945 (the Act), I am satisfied on reasonable grounds that the persons and entities specified in Schedule 1 are persons and entities mentioned in paragraph 1(c) of United Nations Security Council resolution 1373 (2001) and declare that each of their listings under section 15 of the Act continues to have effect.
 

Note 1: Under section 20 of the Charter of the United Nations (Dealing with Assets) Regulations 2008, the Minister must be satisfied that the person or entity is mentioned in paragraph 1 (c) of Resolution 1373 (2001) of the Security Council of the United Nations.

Note 2: Under section 40 of the Charter of the United Nations (Dealing with Assets) Regulations 2008, the Department of Foreign Affairs and Trade maintains a list of all persons, entities, assets and classes of assets currently listed under section 15 of the Act, and has published this list on the internet at www.dfat.gov.au/sanctions/consolidated-list.html.

Application for sanctions permit to use or deal with frozen assets

 

The owner or holder of a frozen asset may apply for authorisation to use or deal with the asset in a specified way. The application must be in writing and specify whether the application relates to a basic expense dealing, a contractual dealing or an extraordinary expense dealing as those terms are defined in section 30 of the Charter of the United Nations (Dealing with Assets) Regulations 2008. Applications may be submitted through the Department of Foreign Affairs and Trade’s Online Sanctions Administration System at https://sanctions.dfat.gov.au.

 

 

 

Overview

The Charter of the United Nations Act 1945 was enacted in 1945 to address Australia's obligations under international law, particularly in the context of the United Nations and its resolutions, including those concerning sanctions and the freezing of assets of individuals and entities associated with terrorism and other international security threats. This Act was designed to ensure Australia's compliance with its international commitments by facilitating the implementation of United Nations Security Council resolutions. The enacting body was the Parliament of Australia. The policy objective of this legislative framework is to support international efforts to combat terrorism and other threats to global peace and security by aligning Australia's domestic laws with relevant United Nations mandates. The Charter of the United Nations Act 1945 provides a legal basis for Australia to give effect to United Nations Security Council resolutions, including those that mandate the freezing of assets of individuals and entities designated by the Security Council as being involved in terrorist activities.

Scope and Application

The Charter of the United Nations Act 1945 Listing Declaration (No. 6) 2016 applies to the individuals and entities listed in Schedule 1, which are deemed necessary to give effect to the decisions of the United Nations Security Council as outlined in paragraph 1(c) of Resolution 1373 (2001). This Act ensures that these listed persons and entities remain subject to the sanctions and restrictions specified under section 15 of the Charter of the United Nations Act 1945. The Declaration is effective from the date of its signature and is applicable nationally, as it concerns the enforcement of United Nations Security Council resolutions within Australia. The Act extends its application through the Charter of the United Nations (Dealing with Assets) Regulations 2008, which mandates the listing of individuals and entities in line with the United Nations' decisions and maintains a public list of all sanctioned individuals and entities. The Act does not specify any exclusions or exemptions within the Declaration itself, but the procedures for requesting reasons for listing, applying for revocation of a listing, and seeking a permit to deal with frozen assets are outlined in Schedule 2.

The Act imposes several obligations on the parties or entities it governs. Firstly, the listed individuals and entities are subject to asset freezing measures, meaning their assets are to be frozen and cannot be used or dealt with without a permit. This is a direct consequence of their listing under the Act. Secondly, the Department of Foreign Affairs and Trade is mandated to maintain and publish a list of all persons, entities, assets, and classes of assets currently listed under section 15 of the Act. This transparency measure ensures that the public and relevant stakeholders are aware of the entities that are subject to sanctions. Thirdly, listed persons or entities have the right to request a statement of reasons for their listing from the Department of Foreign Affairs and Trade. Additionally, they can apply to the Minister for Foreign Affairs to have their listing revoked if they believe the reasons for their inclusion are no longer valid. Failure to comply with the provisions of the Charter of the United Nations Act 1945 or the regulations can result in significant legal consequences. Specifically, individuals or entities that deal with the assets of listed persons or entities without the requisite permit may face civil and criminal penalties. Under section 30 of the Charter of the United Nations (Dealing with Assets) Regulations 2008, the maximum penalties for contravening the asset-freezing provisions can include substantial fines and imprisonment. For corporations, the maximum penalty can be up to 500,000 penalty units or ten times the value of the assets involved, whichever is greater. For individuals, the maximum penalty can be up to 5,000 penalty units or imprisonment for up to five years, or both. These stringent penalties underscore the importance of compliance with the Act and the associated regulations.
