Overview

The Telecommunications Act 1997 was enacted by the Parliament of Australia to establish a comprehensive regulatory framework for the telecommunications industry. This Act was introduced to address the need for modern, efficient, and consumer-focused regulation in response to the rapid technological changes in the telecommunications sector. The overarching policy objective of the Act is to facilitate the growth and development of the telecommunications industry while ensuring fair competition and protecting the interests of consumers. The Act provides the Australian Communications and Media Authority with the authority to grant carrier licences, regulate the industry, and impose conditions that safeguard the public interest. On 30 October 2023, the Authority granted a carrier licence to Swoop Infrastructure Pty Ltd, reflecting its commitment to fostering competition and innovation within the telecommunications landscape.

Scope and Application

The Telecommunications Act 1997, as amended, provides a comprehensive legislative framework governing telecommunications services and infrastructure within Australia. The Act applies to various entities, including telecommunications carriers, service providers, and infrastructure companies, regulating their conduct and operations to ensure the efficient, effective, and fair provision of telecommunications services. The geographic reach of the Act is national, governing all telecommunications activities across Australia, including its states, territories, and external territories. The Act may extend or restrict its application through subordinate instruments, such as regulations or determinations, which provide additional detail or modify the operation of the primary legislation. Notably, certain exclusions or exemptions may apply, such as to government-operated services or specific types of telecommunications infrastructure, as detailed within the Act or associated regulations. The recent grant of a carrier licence to Swoop Infrastructure Pty Ltd under subsection 56(1) exemplifies the Act’s role in authorising and regulating entities involved in telecommunications, subject to the conditions specified in Division 3 of Part 3 of the Act.

Key Provisions

The Australian Communications and Media Authority (ACMA) has granted a carrier licence to Swoop Infrastructure Pty Ltd (ACN 671 420 607) under subsection 56(1) of the Telecommunications Act 1997. This licence allows Swoop Infrastructure to provide telecommunications services as specified in the licence conditions outlined in Division 3 of Part 3 of the Act. These conditions typically include provisions about the technical standards, service quality, consumer protection, and other operational requirements that the company must adhere to while offering its services. Under the Act, Swoop Infrastructure is obligated to comply with various statutory requirements. These include adhering to the licence conditions mentioned above, ensuring that their operations meet the standards set forth by ACMA, and maintaining records and documentation as required by the Act. The company must also ensure that its services do not infringe on the rights of other service providers or consumers and must engage in practices that are fair and transparent. Additionally, Swoop Infrastructure is required to report any changes in their business operations or services to ACMA in a timely manner. Failure to comply with the provisions of the Telecommunications Act 1997 or the conditions of the carrier licence can result in significant consequences. The Act includes provisions for both civil and criminal penalties. Civil penalties can include fines, and in severe cases, the revocation of the carrier licence. Criminal offences may be pursued for more serious breaches, with potential penalties including substantial fines and imprisonment. The exact penalties depend on the nature and severity of the breach, but the Act provides clear guidance on the possible consequences for non-compliance.
