Overview
The Telecommunications Act 1997 was enacted by the Parliament of Australia to regulate telecommunications services across the country, ensuring fair competition and access to reliable communication services. This Act was introduced to address the need for a comprehensive legal framework to manage the rapidly evolving telecommunications industry, including the provision of carrier licences to entities capable of delivering these services effectively. The policy objective of the Act is to facilitate the provision of telecommunications services that are affordable, accessible, and of high quality, while also ensuring compliance with national standards and consumer protection measures. The Australian Communications and Media Authority, as a key regulatory body under this Act, plays a crucial role in granting carrier licences, such as the one awarded to Auswide Broadband Pty Ltd on 5 December 2025, thus enabling the company to operate as a licensed telecommunications carrier on a nationwide basis.
Scope and Application
The Telecommunications Act 1997 applies to entities that seek to provide telecommunications services in Australia, including the granting of carrier licences to companies such as Auswide Broadband Pty Ltd. The Act establishes the framework for the regulation of telecommunications services across the Commonwealth, ensuring that the telecommunications sector operates efficiently and meets the public interest. The grant of a carrier licence under this Act enables Auswide Broadband Pty Ltd to provide telecommunications services nationwide. The jurisdictional reach of the Act extends to all telecommunications activities within Australia, overseen by the Australian Communications and Media Authority (ACMA). The Act includes provisions for the conditions under which carrier licences are granted and regulated, as outlined in Division 3 of Part 3 of the Act, which can be accessed through the Federal Register of Legislation. The Act may also extend or restrict its application through subordinate instruments, which are detailed in the relevant sections of the legislation.
Key Provisions
The Telecommunications Act 1997 (section 56(1)) provides for the granting of carrier licences to telecommunications carriers, and in this instance, it notifies the public that a carrier licence was granted to Auswide Broadband Pty Ltd on 5 December 2025. This licence allows Auswide Broadband to operate as a telecommunications carrier across Australia, providing specified services in accordance with the conditions set forth in the Act. The licence is issued under subsection 56(1) of the Act, which outlines the requirements for obtaining such a licence. The notification also references the conditions of carrier licences detailed in Division 3 of Part 3 of the Act.
The Telecommunications Act 1997 imposes specific obligations and requirements on entities granted a carrier licence, such as Auswide Broadband. These obligations include complying with the conditions of the licence, which may encompass technical, financial, and operational standards. The licensee must also ensure that their operations adhere to any applicable codes of practice, and they must maintain adequate records as required by the Act. Furthermore, the licensee is expected to provide the services as described in their licence application and ensure that these services meet the quality and availability standards set out by the Australian Communications and Media Authority.
Failure to comply with the obligations and requirements of the Telecommunications Act 1997 can result in various consequences. The Act provides for both civil and criminal penalties for breaches. Civil penalties may include fines, which can be substantial depending on the severity of the breach. For example, section 263 of the Act allows for fines up to $50,000 for non-compliance with licence conditions. Additionally, criminal offences may be pursued under sections such as 264, which carries potential penalties including fines of up to $250,000 and/or imprisonment for up to two years for serious breaches. The Act also provides for the imposition of administrative penalties, which may include the suspension or revocation of the carrier licence, ensuring that the carrier remains compliant with the statutory requirements.
