Overview

Statutory Rules 1942 No. 532 amends the Canned Fruits Export Control (Staff) Regulations under the Canned Fruits Export Control Act 1926-1938. Enacted by the Governor-General, with the advice of the Federal Executive Council, the regulation addresses the need to adjust salaries based on the cost of living, particularly in response to economic conditions during the Second World War. The objective of the regulation is to ensure that salaries of staff employed under the Canned Fruits Export Control Act are varied according to changes in the weighted average retail price index number for the six State capital cities of Australia. The policy intent is to maintain equitable remuneration for employees amidst fluctuations in the cost of living.

Scope and Application

The Canned Fruits Export Control Regulations 1942, made under the Canned Fruits Export Control Act 1926-1938, apply to personnel employed within the framework of the canned fruits export control system in Australia. The regulations specifically address the salaries of staff involved in this export control, ensuring adjustments are made in line with variations in the cost of living, as indicated by the weighted average retail price index number for the six state capital cities. These regulations are applicable across the Commonwealth of Australia, and they extend to the salary adjustments of staff involved in the canned fruits export control activities. The Act provides a mechanism to increase or decrease salaries based on the retail price index, offering a safeguard against inflation or deflation. The regulations do not specify exclusions or exemptions but rather apply generally to all staff within the purview of the canned fruits export control system unless otherwise directed by the Minister. The flexibility of the regulations allows for adjustments through subordinate instruments, ensuring the salary adjustments remain relevant to economic conditions.

Key Provisions

The Canned Fruits Export Control (Staff) Regulations 1942 (C1942L00532) introduce a mechanism to adjust salaries of staff employed under the Canned Fruits Export Control Act 1926-1938 based on variations in the cost of living. Regulation 4aa specifies the methodology for these adjustments. If the weighted average retail price index number for the six State capital cities, as published by the Commonwealth Court of Conciliation and Arbitration, falls below 81.7 for the six months ending on 31 March or 30 September, salaries will be reduced. Conversely, if the index number exceeds 83.9, salaries will be increased. The amount of adjustment is determined by the index number group within which the index number falls, with further adjustments made if the index number deviates significantly from these thresholds. Additionally, a fixed amount is added to the salaries of all staff. These Regulations impose obligations on the relevant authorities and staff to monitor the index numbers and make the necessary salary adjustments as per the stipulated conditions. The Minister has the discretion to direct otherwise for individual officers. The adjustments are to be made from the first fortnightly pay period beginning in May or November following the six-month period assessed. Failure to comply with the provisions of these Regulations could lead to penalties, although the specific nature and extent of such penalties are not detailed within the text provided. The Regulations are designed to ensure that salaries are adjusted in line with the cost of living, thereby maintaining the purchasing power of staff salaries. The adjustments are automatic unless the Minister directs otherwise, indicating a structured approach to salary management in response to economic indicators.
