Overview
The Statutory Rules 1938, No. 101, Regulations Under the Canned Fruits Export Control Act 1926-1938, were introduced to address the need for amendments to the existing regulations governing the export control of canned fruits in Australia. Enacted by the Governor-General in Council, these regulations reflect the evolving requirements of the industry and the administrative changes necessitated by the establishment of the Australian Canned Fruits Board. The policy objective is to streamline the regulatory framework and ensure that the governance and operational aspects of the canned fruit export sector are efficiently managed by the newly constituted board. This legislative instrument amends the definitions and nomenclature in the original regulations to align with the new board, thereby ensuring that the legal framework remains current and effective in supporting the industry.
Scope and Application
The Regulations under the Canned Fruits Export Control Act 1926-1938 pertain specifically to the governance and administration of the Australian Canned Fruits Board, which is tasked with overseeing the export of canned fruits from Australia. These regulations apply to the members and officials of the Board, as well as any other individuals or entities involved in the export process of canned fruits. The geographic reach of these regulations is confined to the Commonwealth of Australia, ensuring that the export activities are managed within the national framework. The amendments outlined in the Statutory Rules modify existing definitions and nomenclature within the Canned Fruits Export Control (Poll and Election of Board) Regulations, reflecting the transition from the Canned Fruits Export Control Board to the Australian Canned Fruits Board. This change encompasses the updating of official forms and documents to reflect the new Board's name. The scope of the Act is not explicitly stated to have exclusions or exemptions, but it is understood that its application may be further detailed or restricted through subordinate instruments as necessary.
Key Provisions
The Regulations under the Canned Fruits Export Control Act 1926-1938 (C1938L00101) primarily amend the Canned Fruits Export Control (Poll and Election of Board) Regulations. These amendments are made to ensure that the regulations are in line with the current legislative framework, particularly in respect to the terminology used within the Act and the names of the governing bodies. Specifically, Regulation 3 of the Canned Fruits Export Control (Poll and Election of Board) Regulations has been altered by changing the year in the reference to "The Act" from "1926" to "1926-1938" (section 1(a)). Furthermore, the definitions of "The Minister" and "Officer" have been removed from the regulations (section 1(b)). Additionally, the Schedule to these Regulations has been amended to replace references to the "Canned Fruits Export Control Board" with "Australian Canned Fruits Board" in Forms A and B (section 2).
These Regulations impose specific obligations on the parties involved in the canned fruits export industry. The amendments ensure that the terminology used in the governing documents accurately reflects the current state of the law and the identity of the governing body. The omission of the definitions of "The Minister" and "Officer" means that any future references to these roles must be understood in the context of the Canned Fruits Export Control Act 1926-1938 and the current administrative structure. The changes to the forms in the Schedule necessitate that all official documentation and communication must use the updated name, "Australian Canned Fruits Board," to maintain consistency and legal accuracy.
Failure to comply with these Regulations may result in various legal consequences. While the specific penalties for non-compliance are not detailed within the text, breaches of statutory requirements generally attract civil or criminal penalties, depending on the nature and severity of the breach. Typically, non-compliance with such regulations might result in fines or other penalties as prescribed by the relevant legislation. The exact penalties would be determined by the courts based on the specifics of the case and the impact of the non-compliance on the regulated industry.
