Overview

The Provisional Regulations under the Defence Acts 1903-1904, enacted in 1906, were introduced to address urgent operational needs within the Commonwealth Cadet Corps. These regulations, issued by the Governor-General in Council, certify the immediate implementation of specific provisions concerning cadet uniforms and related expenses, pending parliamentary approval. The primary objective of these regulations was to establish a structured allowance for the provision of uniforms and related incidental expenses to cadets who had completed the requisite musketry course, thereby ensuring that the cadet corps could be adequately equipped and maintained without diverting funds to unintended purposes. The allowance, set at 7s. 6d. per cadet annually, was to be strictly used for its intended purpose, reinforcing the financial discipline and accountability within the cadet system.

Scope and Application

The Provisional Regulations under the Defence Acts 1903-1904 apply to the Commonwealth Cadet Corps, specifically governing the allowance provided for cadet uniforms and related expenses. These regulations impact Officers Commanding Detachments who are tasked with managing the annual allowance of 7s. 6d. per cadet who has completed the prescribed musketry course. This allowance is to be used strictly for the supply of authorized uniform patterns and for incidental expenses such as cleaning, repairs, and alterations. The regulations clearly state that no portion of this allowance can be diverted to other purposes, nor can any monetary grant be made directly to the cadets. These provisions are subject to parliamentary approval and are designed to ensure that the funds are used appropriately for the intended purpose of supporting the cadet corps. The regulations apply across the Commonwealth, aligning with the overarching Defence Acts, and come into operation as Provisional Regulations due to their urgent nature.

Key Provisions

The Provisional Regulations under the Defence Acts 1903-1904, particularly Section 22, introduce a clothing allowance for Officers Commanding Detachments within the Commonwealth Cadet Corps. This allowance, set at 7s. 6d. per cadet annually, is contingent upon parliamentary approval and is intended to support the provision of uniforms and cover incidental expenses like cleaning and repairs (Section 22, sub-paragraph (a)). It is crucial that this allowance is strictly used for its intended purpose and not diverted to other ends or given directly to cadets as monetary grants. These regulations impose specific obligations on Officers Commanding Detachments, requiring them to ensure that the clothing allowance is utilized solely for the specified purposes. They must manage the allowance in a manner that provides uniforms and covers related expenses without any diversion of funds (Section 22, sub-paragraph (a)). Officers must also adhere to the stipulated conditions of the allowance to maintain compliance with the regulations. Breaches of these regulations could lead to administrative and possibly legal consequences. Although the specific offences, penalties, or consequences are not detailed in the text, non-compliance with such provisions typically results in disciplinary action or financial penalties. Given the historical context, it is reasonable to infer that severe breaches could have led to significant administrative repercussions, including potential removal from command or financial restitution. The regulations also underscore the importance of accountability and transparency in the use of public funds, particularly in the context of the Commonwealth Cadet Corps. This is essential to ensure that the resources allocated for cadet uniforms and related expenses are used effectively and efficiently, thus maintaining the integrity of the program and the trust of the public. Overall, these provisions aim to ensure that the Commonwealth Cadet Corps is well-equipped and properly maintained, thereby supporting the training and development of cadets within the defence framework. Compliance with these regulations is crucial for the smooth operation and effectiveness of the cadet program.
