Overview
The Butter Fat Levy Acts 1965, enacted by the Parliament of Australia, were introduced to establish a levy on butter fat to support the dairy industry. This legislation provided a framework for regulating the amount of the levy, which is intended to fund activities such as research and promotion within the sector. The 1966 Statutory Rules, made under these Acts, were developed in response to recommendations from the Australian Dairy Produce Board and the Dairy Produce Research Committee, ensuring the levy amounts were aligned with industry needs and research priorities. The Governor-General, acting on the advice of the Federal Executive Council, made these Regulations to adjust the prescribed amounts of levy on butter fat, effective from 1 July 1966, reflecting the policy objective of maintaining a balanced and supportive regulatory environment for the dairy industry.
Scope and Application
The Regulations under the Butter Fat Levy Acts 1965, which were made by the Governor-General in and over the Commonwealth of Australia, specify the amounts of levy applicable to butter fat, coming into effect on the first of July, 1966. These regulations apply to all entities involved in the production, export, or sale of butter fat within Australia, ensuring compliance with the prescribed levy amounts. The Australian Dairy Produce Board, advised by the Dairy Produce Research Committee, makes recommendations to the Minister regarding these amounts, which are subsequently considered by the Governor-General in the formulation of these regulations. The amendments adjust the levy amount from 8 cents to 10 cents per unit of butter fat, thus impacting the financial obligations of those within the dairy industry. The regulations are designed to extend their reach nationally, applying uniformly across all states and territories within the Commonwealth of Australia.
Key Provisions
The main operative sections of these Regulations, under the Butter Fat Levy Acts 1965, involve the amendment of the prescribed amount of levy on butter fat. Specifically, Regulation 2 of these Regulations amends Regulation 3 of the Butter Fat Levy (Amounts of Levy) Regulations by changing the levy amount from 8 cents to 10 cents per kilogram of butter fat (sections 2 and 3). This amendment is effective from the first day of July, 1966 (section 1).
The obligations and requirements imposed by these Regulations primarily concern those involved in the production, processing, or sale of butter fat. Producers and processors of butter fat must ensure that the revised levy amount is accounted for and remitted to the appropriate authorities in accordance with the Butter Fat Levy Acts 1965. Retailers and distributors of butter fat must also comply with the new levy amount when calculating the cost of butter fat products they supply. These entities are required to adhere to the new levy amount to avoid any non-compliance issues.
The Regulations do not explicitly outline specific offences, penalties, or consequences for breach within the text provided. However, under the general provisions of the Butter Fat Levy Acts 1965, non-compliance with the prescribed levy amounts could lead to legal consequences. This might include financial penalties, legal action, or other enforcement measures as deemed appropriate by the relevant authorities. The maximum penalties would be in line with those stipulated in the primary Act, which might include fines or other sanctions for failure to comply with the levy requirements.
In summary, these Regulations amend the prescribed levy amount on butter fat from 8 cents to 10 cents per kilogram, effective from 1 July 1966. They impose obligations on butter fat producers, processors, and retailers to comply with the new levy amount. While the specific penalties for non-compliance are not detailed in the provided text, they would likely follow those outlined in the overarching Butter Fat Levy Acts 1965.
