Overview
Statutory Rules 1973 No. 1, the regulations made under the Broadcasting and Television Act 1942-1972, were enacted to address the need for updated provisions governing travelling allowances for members of the Board and the General Manager of the Commission. These regulations were introduced by the Governor-General, acting on the advice of the Federal Executive Council, and were made to ensure that the travelling allowances were consistent with the current economic conditions and responsibilities of the roles. The policy objective was to provide fair and adequate compensation for the travel undertaken by these officials in the performance of their duties. These regulations applied to travel undertaken on or after specific dates in 1972, reflecting the intent to implement the changes in a timely manner to support the operational needs of the Board and the Commission.
Scope and Application
The Broadcasting and Television Regulations, as amended, are made under the authority of the Broadcasting and Television Act 1942-1972 and apply across the Commonwealth of Australia. These regulations govern various aspects of broadcasting and television, including specific allowances and payments. Notably, Regulation 28, as amended by these Regulations, pertains to travelling allowances for members of the Board and the General Manager of the Commission, with specified rates effective from particular dates in 1972. The amendments to the travelling allowances set the rate at Twenty-five dollars per day for full-time Board members and Thirty-four dollars per day for the General Manager. These new rates apply to travel undertaken on or after the 24th of January 1972 for Board members and the 17th of May 1972 for the General Manager, ensuring that all subsequent allowances are calculated accordingly.
Key Provisions
The Statutory Rules 1973 No. 1 amends the Broadcasting and Television Regulations under the Broadcasting and Television Act 1942-1972, specifically targeting Regulation 28 which pertains to travelling allowances. Regulation 28 (2) is amended to adjust the daily rate of travel allowance for members of the Board and the General Manager of the Commission. Previously, the allowance rate was Twenty-five dollars per day for members of the Board, including part-time members. This regulation now differentiates between full-time and part-time members of the Board, setting the allowance at Twenty-five dollars per day for full-time members while excluding part-time members from this rate. Additionally, the allowance for the General Manager of the Commission is now set at Thirty-four dollars per day.
These amendments impose specific obligations on the parties involved, primarily those who are responsible for the payment and calculation of travel allowances. For instance, the Board and the General Manager must now ensure that their travel allowances are calculated according to the new rates specified in the amended Regulation 28 (2). This change necessitates an update in their financial and administrative processes to comply with the new rates. The application of these new rates is retrospective, applying to travel undertaken on or after 24 January 1972 for members of the Board and 17 May 1972 for the General Manager.
Breaching the provisions of these Regulations by failing to comply with the specified travel allowance rates could lead to administrative or financial discrepancies. While the Regulations themselves do not explicitly state offences, penalties, or consequences for non-compliance, any failure to adhere to the stipulated allowances could result in disputes over compensation, audits, or other regulatory actions under the broader framework of the Broadcasting and Television Act 1942-1972.
