Bounty (Paper) Regulations
Issued by the Authority of the Minister for Industry and Commerce.
The Bounty (Paper) Act 1979 provides assistance, by way of a bounty scheme, to manufacturers in Australia of certain types of paper.
The purpose of the accompanying regulations is to introduce regulations under this Act to prescribe:
(i) the conditions to be complied with for the purposes of the Act, in connection with the manufacture of bountiable paper;
(ii) the manner in which, and the time within which, an application for bounty is to be made;
(iii) the information to be supplied by applicants in connection with such applications; and
(iv) the form and manner of appointment, by manufacturers of bountiable paper, of agents authorised to sign documents required to be signed under the Act or Regulations.
Regulation 2
Defines the expressions “authorized agent” and “the Act” for the purposes of the regulations;
Regulation 3
Specifies the conditions to be complied with in connection with the manufacture at registered premises of bountiable paper, namely -
(a) that each reel or palletized ream of bountiable paper sold by the manufacturer shall be allotted numbers or symbols from which the date and number of the production run in which that reel or palletized ream was manufactured may be determined; and
(b) that the numbers or symbols allotted to a reel or palletized ream of bountiable paper shall be marked on the reel or palletized ream of bountiable paper by means of a stencil or on a tag that is securely fixed to the reel or palletized ream.
Regulation 4
Requires the application for bounty:
(a) to be in writing;
(b) to be signed by, or on behalf of, the manufacturer of the paper in the presence of a witness;
(c) to state the name and address of the witness and declare that the application was signed in the presence of the witness; and
(d) to be delivered to certain officers within certain specified periods.
Regulation 5
Sets out the information to be supplied by the applicants for bounty including -
(a) the name and address of the manufacturer of the paper;
(b) the address of the registered premises at which the paper was manufactured;
(c) in respect of bountiable coated or bountiable uncoated paper:
(i) the date on which the paper was sold by the manufacturer;
(ii) the weight of the paper sold; and
(iii) the date on which the manufacturer of the paper sold was completed;
(d) the amount of bounty applied for;
(e) whether a previous application for bounty has been made in respect of other paper that has been sold by the manufacturer in the same period to which the Act applies as the paper to. which the present application relates and, if such an application has been made -
(i) the date of the application;
(ii) the amount of bounty applied for in the application;
(iii) the date of any payment made by way of bounty or advance on account of bounty in respect of the paper referred to in the application; and
(iv) the amount of any payment made by way of bounty or advance on account of bounty, as the case may be;
(f) whether a previous application for bounty has been made in respect of the paper to which the present application relates and, if such an application has been made -
(i) the date of the application;
(ii) the reason for making the application that is now being made;
(iii) the date of any payment made by way of bounty or advance on account of bounty in respect of the paper; and
(iv) the amount of any payment made by way of bounty or advance on account of bounty, as the case may be.
Regulation 6
Provides the authority for a manufacturer of bountiable paper to appoint an authorised agent, who must be at least 18 years of age, for the purpose of signing on his behalf any document that the manufacturer may be required to sign by, or for the purposes of, the Act or the Regulations, and provides that the instrument of appointment, which shall be delivered to a Collector or to the Comptroller-General, shall be in accordance with the form contained in the Schedule to the Regulations. Provision is also made for the manufacturer to be able to revoke the appointment of an authorised agent.
Regulation 7
Authorises a director or secretary of a company to sign documents on behalf of that company.
