Overview

The Statutory Rules 1970 No. _________, enacted by the Governor-General in Council under the authority of the Banking Act 1959-1967, serves to amend the existing Banking (Statistics) Regulations. This legislation was introduced to address the need for updating and aligning the prescribed dates by which trading banks must furnish their balance sheets and statements to ensure that statistical data remains current and relevant. The policy objective behind these amendments is to maintain the integrity and timeliness of banking statistics, which are critical for regulatory oversight and economic analysis. The amendments, which were made by the Minister of State for Immigration acting on behalf of the Treasurer, involve updating the prescribed dates for specific banks, including Australia and New Zealand Banking Group Limited and The English, Scottish and Australian Bank, Limited. This change reflects the evolving landscape of the banking sector and seeks to ensure that statistical reporting remains consistent and comprehensive. The regulations were notified in the Commonwealth Gazette and are intended to streamline the reporting process while enhancing the accuracy and timeliness of the data collected.

Scope and Application

The Banking (Statistics) Regulations 1970, made under the Banking Act 1959-1967, apply to trading banks within the Commonwealth of Australia, specifically detailing the prescribed dates for these banks to furnish their balance sheets and statements. This regulation mandates that institutions such as Australia and New Zealand Banking Group Limited and the English, Scottish and Australian Bank, Limited must submit their financial documents by the end of September each year. The amendment to these regulations not only incorporates the Australia and New Zealand Banking Group Limited into the list of entities required to comply but also extends the deadline for the English, Scottish and Australian Bank, Limited to align with the other specified banks. This regulation underscores the Commonwealth's oversight of banking statistics, ensuring uniformity and timeliness in financial reporting across designated banks.

Key Provisions

The main operative sections of these regulations pertain to the amendments of the Banking (Statistics) Regulations, specifically targeting the prescribed dates for trading banks to submit balance-sheets and statements. Regulation 4 is amended to add a new entry for Australia and New Zealand Banking Group Limited, requiring them to furnish their balance-sheets and statements by the 30th of September each year. Additionally, the regulation removes the previous entry for The English, Scottish and Australian Bank, Limited, which previously had a submission deadline of the 30th of June, and replaces it with a new deadline of the 30th of September. These changes aim to standardise the reporting dates across these financial institutions, ensuring uniformity and comparability in the financial data submitted to the relevant authorities. The obligations imposed by these regulations are primarily on the trading banks themselves. Australia and New Zealand Banking Group Limited and The English, Scottish and Australian Bank, Limited must now comply with the new reporting deadlines. This means they need to ensure that their balance-sheets and statements are prepared and submitted by the 30th of September each year. This requirement is in addition to any other reporting obligations they may have under different sections of the Banking Act 1959-1967 or other relevant legislation. Failure to comply with these deadlines could result in penalties or other consequences as outlined in the applicable laws. The regulations do not explicitly state any specific offences, penalties, or consequences for non-compliance within the text provided. However, under the general provisions of the Banking Act 1959-1967, non-compliance with regulatory requirements can lead to various civil or criminal penalties. These may include fines, orders for restitution, or in severe cases, criminal charges against individuals responsible for the non-compliance. The exact penalties would depend on the nature and severity of the breach, as well as any additional provisions outlined in the Banking Act or other relevant statutes.
