Overview

The Banking (Statistics) Regulations 1968 was enacted to provide more precise and updated reporting requirements for trading banks under the Banking Act 1959-1967. This legislative instrument was introduced by the Federal Executive Council, acting on the advice of the Governor-General, and was aimed at enhancing the collection and timeliness of banking statistics. The policy objective of this regulation is to ensure that banks provide their balance sheets and financial statements by specified dates, thereby facilitating better oversight and regulation of the banking sector. This was achieved by amending the previous regulations to include a new table listing the prescribed dates for each bank to furnish their balance sheets and statements, thereby addressing the need for more structured and timely financial reporting from banks. The 1968 Regulations replace earlier versions, which had been subject to amendments in 1966, ensuring that the requirements are kept up-to-date with the evolving financial landscape. By mandating specific dates for each bank to submit their financial data, the regulation seeks to streamline the process of data collection and improve the accuracy of financial statistics used by the government and other stakeholders. This legislative instrument reflects the Commonwealth Government's commitment to maintaining a robust and transparent banking system through better regulatory practices.

Scope and Application

The Banking (Statistics) Regulations 1968, made under the Banking Act 1959-1967, pertain specifically to the submission of balance-sheets and statements by designated trading banks. The regulation applies to a comprehensive list of banks, including Australia and New Zealand Bank Limited, The Bank of Adelaide, Bank of China, and several others, each with a specified date by which they must furnish their financial statements. The regulation delineates the reporting dates for each bank, ranging from 30th June to 31st August, thereby ensuring that financial data is uniformly collected and reported within the stipulated timeframes. This regulation underscores the Commonwealth's jurisdiction over banking statistics, extending its reach to multiple banks operating within the national scope. No explicit exclusions or exemptions are mentioned in the text, implying that the regulation applies broadly to the listed entities unless otherwise specified through subordinate instruments. The regulation, as amended, serves to standardise the reporting requirements across various banks, enhancing the transparency and consistency of banking statistics in Australia.

Key Provisions

This legislative instrument, made under the Banking Act 1959-1967, amends the Banking (Statistics) Regulations to set new prescribed dates for trading banks to furnish balance sheets and statements. Section 4 of the regulation changes the dates for reporting these financial documents, specifying new deadlines for various banks, such as the Australia and New Zealand Bank Limited, which is now required to submit its balance sheet and statements by the 30th of September each year (para 4). The obligations imposed by these regulations are primarily administrative, requiring the designated banks to comply with the specified reporting dates. Each bank must ensure that they furnish their balance sheets and statements by the dates prescribed in the amended table. This requirement is designed to ensure that the financial health and status of these institutions are transparent and up-to-date, allowing for effective monitoring and regulation by the relevant authorities. While the legislative instrument itself does not explicitly state offences, penalties, or consequences for non-compliance, it can be inferred that failing to adhere to the prescribed dates for submitting balance sheets and statements could result in regulatory action under the Banking Act 1959-1967. Such non-compliance could potentially lead to administrative penalties, investigations, or even more severe consequences depending on the extent and impact of the failure to comply. The specific penalties would be determined in the context of the overarching Banking Act, which may include fines or other enforcement measures.
