Overview

The Banking (Savings Banks) Regulations 1977, issued under the Banking Act 1959, were enacted to amend the existing regulations concerning the investment of funds by savings banks. This legislative instrument, made by the Administrator of the Government of the Commonwealth of Australia and advised by the Federal Executive Council, addresses the need to expand the range of permissible investments for savings banks, specifically including registered stock issued by the Australian Industry Development Corporation established by the Australian Industry Development Corporation Act 1970. The regulations were designed to enhance the financial flexibility of savings banks, allowing them to invest in a broader array of securities, thereby supporting broader economic development initiatives. The amendments reflect an effort to align the regulatory framework with evolving financial practices and economic policies, ensuring that savings banks can operate more effectively within the Australian financial system.

Scope and Application

The Statutory Rules 1977 No. 86, made under the Banking Act 1959, pertain to the regulation of savings banks within Australia. These regulations apply to savings banks and their operations, specifically targeting the investment of funds these institutions hold. The regulations amend existing rules to include registered stock issued by the Australian Industry Development Corporation as an eligible investment, broadening the scope of permissible investments for savings banks. This amendment aims to enhance the investment options available to savings banks, potentially leading to more diversified portfolios and increased financial stability. The geographic reach of these regulations is nationwide, as they are applicable across the Commonwealth of Australia, thereby affecting all savings banks operating within its jurisdiction. There are no explicit exclusions mentioned in the provided text, suggesting that the amendments apply broadly to all savings banks unless otherwise specified by other legislation or regulations. The regulations also extend their application through subordinate instruments, indicating that further amendments or clarifications may be introduced to refine or expand the scope of these provisions.

Key Provisions

The principal operative sections of these regulations pertain to the amendments of the Banking (Savings Banks) Regulations, particularly focusing on the investment of funds by savings banks. Regulation 5 of the Banking (Savings Banks) Regulations is specifically amended. Firstly, a new sub-regulation (2a) is inserted after sub-regulation (2) to clarify that the term "securities issued by an authority constituted by or under an Act" includes registered stock issued by the Australian Industry Development Corporation, established under the Australian Industry Development Corporation Act 1970. This amendment aims to expand the scope of permissible investments for savings banks. Secondly, sub-regulation (3) is modified by omitting certain references and adding a new reference, paragraph (j), thus updating the list of permissible investment categories. The regulations impose several obligations and requirements on savings banks governed by the Banking Act 1959. Savings banks must ensure their investments comply with the updated list of permissible securities as outlined in the amended Regulation 5. This includes the inclusion of registered stock issued by the Australian Industry Development Corporation, thereby broadening their investment options. Furthermore, savings banks need to adhere to the newly structured sub-regulation (3) to maintain compliance with the updated regulatory framework. Breaches of these regulations may lead to civil or criminal consequences, although the specific penalties are not detailed within the regulations themselves. Generally, under the Banking Act 1959, non-compliance with banking regulations can result in financial penalties, enforcement actions, or even criminal charges depending on the severity and intent behind the breach. The exact penalties would be determined in the context of any legal proceedings following a breach.
