Banking (Foreign Exchange) Regulations 1959

Direction relating to foreign currency transactions and to Iran

The Reserve Bank of Australia, pursuant to regulation 5 of the Banking (Foreign Exchange) Regulations 1959, hereby directs that:

  1. a person must not, either on the person’s own behalf or on behalf of another person, buy, borrow, sell, lend or exchange foreign currency in Australia, or otherwise deal with foreign currency in any other way in Australia;
  2. a resident, or a person acting on behalf of a resident, must not buy, borrow, sell, lend or exchange foreign currency outside Australia, or otherwise deal with foreign currency in any other way outside Australia;
  3. a person must not be a party to a transaction, being a transaction that takes place in whole or in part in Australia or to which a resident is a party, that has the effect of, or involves, a purchase, borrowing, sale, loan or exchange of foreign currency, or otherwise relates to foreign currency

where the transaction relates to property, securities or funds owned or controlled directly or indirectly by, or otherwise relates to payments directly or indirectly to, or for the benefit of any person or entity listed in the Annex to this direction.

The Annex to this direction may be amended from time to time.  Any such amendment shall be taken as being part of this direction as from the date specified in the amendment.

This instrument comes into operation on 15 October 2008.

Overview

The Direction relating to foreign currency transactions and to Iran, enacted in 2008, is a legislative instrument under the Banking (Foreign Exchange) Regulations 1959, aimed at addressing issues concerning foreign currency transactions and imposing restrictions on entities associated with Iran. This direction was issued by the Reserve Bank of Australia and prohibits various forms of foreign currency transactions involving entities listed in the annex if such transactions relate to Iran. The objective of this direction is to implement sanctions and restrictions in response to concerns related to Iran's activities, thereby aligning with international efforts to address specific issues associated with Iran.

Scope and Application

Additionally, the Direction prohibits any transaction involving foreign currency where the transaction relates to property, securities, or funds owned or controlled by, or payments to, any person or entity listed in the Annex, which includes a wide range of Iranian financial institutions, corporations, and individuals. The scope of the Direction is further extended to include any transaction that takes place wholly or partly in Australia, or to which a resident is a party, that involves a purchase, borrowing, sale, loan, or exchange of foreign currency related to listed entities. The Direction can be amended through subordinate instruments, which are incorporated into the main Direction as specified in the amendments.

Key Provisions

The primary sections of the Direction relating to foreign currency transactions and to Iran (13/10/2008) (F2008L03785) under the Banking (Foreign Exchange) Regulations 1959, detail the prohibitions on dealing with foreign currency within Australia and by Australian residents abroad. Section 1 of the direction mandates that no person, whether acting on their own behalf or on behalf of another, can buy, borrow, sell, lend, or exchange foreign currency in Australia or engage in any other foreign currency dealings within the country. Breaches of this direction are met with severe penalties.
