Overview

The Autonomous Sanctions (Export Sanctioned Goods—Specified Ukraine Regions) Designation 2023, made under the authority of subregulation 4(3) of the Autonomous Sanctions Regulations 2011, addresses the issue of prohibiting the export of specified goods to certain regions of Ukraine in response to geopolitical considerations. This legislative instrument was introduced to implement Australia's autonomous sanctions regime, ensuring alignment with international efforts to support stability and security in Ukraine. The enactment of this legislation by the Australian government demonstrates a commitment to adhering to international sanctions and participating in coordinated global responses to crises. The policy objective is to restrict the flow of goods that could potentially be used for activities detrimental to peace and security in the specified regions of Ukraine, thereby contributing to broader diplomatic and strategic goals.

Scope and Application

The Autonomous Sanctions (Export Sanctioned Goods—Specified Ukraine Regions) Designation 2023 applies to the export of designated goods to specified regions of Ukraine, specifically as outlined in Schedule 1. This legislative instrument is made under subregulation 4(3) of the Autonomous Sanctions Regulations 2011, and it designates certain goods as export sanctioned goods for the purpose of implementing sanctions against specified regions of Ukraine. The goods listed in Schedule 1 include machinery and related goods, as well as unmanned aerial vehicles, which are identified by their Australian Harmonized Export Commodity Classification (AHECC) codes. This designation means that any Australian person, entity, or any person or entity in Australia must not export these specified goods to the designated regions of Ukraine without the appropriate authorisation, as per the sanctions framework. The geographic scope of this legislation is limited to the specified regions of Ukraine, and it applies to any conduct or transactions involving the export of the designated goods to these regions. The Act does not provide specific exclusions or exemptions, but it does allow for the extension or restriction of its application through subordinate instruments or further legislative amendments. Any uncommenced amendments or editorial changes are accessible on the legislative register and do not affect the text of the compiled law unless specifically noted.

Key Provisions

The Autonomous Sanctions (Export Sanctioned Goods—Specified Ukraine Regions) Designation 2023 (sections 3 and 4) designates certain goods as export sanctioned goods for specific regions in Ukraine. The designated goods include machinery and related items, such as interchangeable tools for hand and machine tools, nuclear reactors, boilers, and electrical machinery (Schedule 1, Part 1). Additionally, it covers unmanned aerial vehicles and their parts (Schedule 1, Part 2). The designation applies to exports of these goods to specified regions within Ukraine, as detailed in the legislation. The Act imposes specific obligations on parties and entities involved in the export of designated goods. Exporters are required to ensure that the goods they export do not fall into the categories specified in Schedule 1 unless they have obtained the necessary permissions or exemptions from the relevant authorities. This includes conducting due diligence to verify that the destination of the goods does not contravene the provisions of the Act. Failure to comply with these obligations can result in legal repercussions. Breaches of the Act may lead to both civil and criminal consequences. For example, the unauthorised export of designated goods to the specified regions in Ukraine can result in significant penalties. Under the Autonomous Sanctions Regulations 2011, individuals may face fines of up to $330,000 or imprisonment for up to 10 years, or both. Corporations may face even higher fines, potentially reaching up to $1.65 million. These penalties reflect the seriousness with which the Australian government treats violations of autonomous sanctions and the importance of compliance to prevent destabilising activities in conflict zones.
