1 Name of Specification

  This Specification is the Autonomous Sanctions (Export Sanctioned Goods – Iran) Amendment Specification 2013.

2 Commencement

  This Specification commences on the day after it is published in the Commonwealth Gazette.

3 Amendment of the Autonomous Sanctions (Export Sanctioned Goods – Iran) Specification 2012

  Schedule 1 amends the Autonomous Sanctions (Export Sanctioned Goods – Iran) Specification 2012.

Repeal the section, substitute:

5 Effective date for specification of an export sanctioned good

  1.    For regulation 4 of the Autonomous Sanctions Regulations 2011, the date on which the specification of an export sanctioned good in Part 1, Part 2 and Part 3 of Schedule 1 takes effect shall be:
    1.                     for a good that is the subject of:
      1.                  a trade contract concluded before the date on which that kind of good was listed in Schedule 1 (the listing date); or
      2.                an ancillary contract necessary for the execution of such a contract; or
      3.             a contract or agreement concluded before the listing date and relating to an investment in Iran made before the listing date,

     the thirtieth day following the listing date;

  1.                    in all other circumstances, the listing date.
  1.    For regulation 4 of the Autonomous Sanctions Regulations 2011, the date on which the specification of an export sanctioned good in Part 4, Part 5 and Part 6 of Schedule 1 takes effect shall be:
    1.                     for a good that is the subject of:
      1.                  a trade contract concluded before the date on which that kind of good was listed in Schedule 1 (the listing date); or
      2.                an ancillary contract necessary for the execution of such a contract; or
      3.             a contract or agreement concluded before the listing date and relating to an investment in Iran made before the listing date,

     the sixtieth day following the listing date;

Division 1 Software

Enterprise Resource Planning software, designed specifically for use in nuclear, military, gas, oil, navy, aviation, financial or construction industries.

Explanatory note: Enterprise Resource Planning software is used for financial accounting, management accounting, human resources, manufacturing, supply chain management, project management, customer relationship management, data services or access control.

 

Overview

The Autonomous Sanctions (Export Sanctioned Goods – Iran) Amendment Specification 2013, made by the Minister for Foreign Affairs under regulation 4 of the Autonomous Sanctions Regulations 2011, was enacted to address the need to impose sanctions on the export of certain goods to Iran. This legislation was introduced to align with international efforts to pressure Iran regarding its nuclear program and other activities deemed contrary to global security interests. By amending the Autonomous Sanctions (Export Sanctioned Goods – Iran) Specification 2012, this specification expands the list of sanctioned goods, thereby tightening the regulatory framework surrounding exports to Iran. The policy objective is to contribute to international efforts to influence Iran's behaviour by restricting the flow of strategic materials and technologies that could support its military capabilities.

Scope and Application

The Autonomous Sanctions (Export Sanctioned Goods – Iran) Amendment Specification 2013 applies to the export of specified goods from Australia to Iran, aiming to enforce sanctions against Iran by controlling the export of certain commodities and technologies. This legislation applies to individuals and entities within the Commonwealth of Australia, focusing on exports of listed goods that are intended for use in Iran. The scope of this specification includes a broad range of items, such as graphite, various metals and their semi-finished forms, key naval equipment and technology, and specific software designed for industrial integration. The geographic reach of this Act is national, affecting all exports from Australia to Iran. The Act delineates specific exclusions and thresholds, particularly concerning the timing of the effect of listing a good as sanctioned, which depends on whether the export contract was concluded before or after the listing date. This Act may be further extended or restricted through subordinate instruments, allowing for adjustments to the list of sanctioned goods or other relevant details as circumstances evolve.

Key Provisions

The Autonomous Sanctions (Export Sanctioned Goods – Iran) Amendment Specification 2013, made under regulation 4 of the Autonomous Sanctions Regulations 2011, introduces new provisions regarding the export of sanctioned goods to Iran. Section 5 of the Amendment Specification specifies the effective dates for the listing of different categories of goods as export sanctioned goods. For goods listed in Parts 1, 2, and 3 of Schedule 1, the effective date is either the listing date or the thirtieth day following the listing date, depending on whether the goods are subject to a pre-existing trade contract, ancillary contract, or investment agreement. For goods listed in Parts 4, 5, and 6 of Schedule 1, the effective date is either the listing date or the sixtieth day following the listing date, again depending on the circumstances outlined in Section 5. This Amendment Specification imposes obligations on entities and individuals to comply with the newly specified sanctions, particularly those involved in the export of the listed goods to Iran. The obligations include ensuring that any pre-existing contracts or agreements do not contravene the sanctions, and that new contracts or agreements do not involve the export of listed goods to Iran after the effective dates specified. Furthermore, entities must ensure that their supply chains do not include the listed goods for the purpose of export to Iran, post-effective dates. Breach of the provisions contained in the Amendment Specification may result in civil or criminal penalties. Under the Autonomous Sanctions Regulations 2011, entities or individuals found to be in breach of the sanctions may face civil penalties, including fines. The maximum penalty for a civil breach can be significant, depending on the nature and severity of the breach. Additionally, criminal sanctions may apply where the breach is intentional or involves gross negligence. Criminal penalties may include imprisonment, with the maximum penalty also varying according to the circumstances of the offence. The specifics of these penalties are detailed in the principal Act and associated regulations.
