Overview

The Automotive Industry Authority Regulations (Amendment) Statutory Rules 1988 No. 362 were enacted by the Authority of the Minister for Industry, Technology and Commerce to address the need for increased representation and effectiveness of the Automotive Industry Authority established under the Automotive Industry Authority Act 1984. This legislative amendment was introduced to enhance the Authority’s capacity to act as a catalyst for change within the automotive industry by increasing the number of members, excluding the senior member, from two to three. This expansion aims to improve the Authority's decision-making processes and responsiveness to industry developments, thereby better fulfilling its policy objective of fostering innovation and competitiveness in the Australian automotive sector.

Scope and Application

The Automotive Industry Authority Regulations (Amendment) Statutory Rules 1988 No. 362 applies to the Automotive Industry Authority established under the Automotive Industry Authority Act 1984. This amendment increases the number of members of the Authority from two to three, excluding the senior member, to enhance the effectiveness of the Authority in driving change within the automotive industry. The changes are applicable nationally, as the Act operates under the Commonwealth jurisdiction, thereby impacting the entire automotive sector across Australia. There are no stated exclusions or exemptions within the scope of these regulations; however, the application may be subject to further definition or restriction through subordinate instruments issued by the Minister for Industry, Technology and Commerce. The primary aim of these amendments is to bolster the Authority's capacity to influence and reform the automotive industry more comprehensively.

Key Provisions

The Automotive Industry Authority Regulations (Amendment) introduces significant changes to the existing regulations under the Automotive Industry Authority Act 1984. The primary amendment (paragraph 1) is the increase in the number of members of the Authority from two to three, in addition to the senior member. This change aims to enhance the effectiveness of the Authority in driving change within the automotive industry. The obligation imposed by this amendment is the necessity for the Authority to now include three members in its decision-making process. This is intended to ensure a broader range of perspectives and expertise is represented, potentially leading to more comprehensive and balanced outcomes. Each member of the Authority is expected to bring specific skills and knowledge to the table, contributing to the overall effectiveness of the organisation. The amendment also implies that the Authority must now manage the additional member’s role within its structure, including responsibilities, expectations, and integration into existing processes. Breaches of the provisions set out in these regulations could lead to civil or criminal consequences, although the specific penalties are not detailed in the Explanatory Statement. However, under the general provisions of the Act, any failure to comply with the regulations could result in fines or other penalties as determined by the relevant court. For instance, section 46 of the Act allows for penalties for non-compliance, and the maximum penalties for breaches can be significant, depending on the severity and intent of the breach. The specific penalties would be determined based on the nature of the breach and the discretion of the court. Overall, the amendment to the Automotive Industry Authority Regulations serves to enhance the Authority's capacity to influence and adapt within the automotive industry. By increasing the number of members, the Authority aims to better reflect the diverse needs and challenges of the sector, ultimately contributing to its long-term sustainability and innovation.
