Overview

The Insurance Act 1973 was enacted to regulate the insurance industry in Australia, ensuring the stability and integrity of the sector. This legislation was introduced to address the need for a comprehensive regulatory framework governing insurance practices, protecting consumers, and maintaining fair and efficient markets. The Act is administered by the Australian Prudential Regulation Authority (APRA), which is tasked with overseeing the financial sector to promote safety and soundness. The policy objective of this authorisation is to allow a specified body corporate, Europ Assistance Australia Pty Ltd, to legally operate as an insurance provider within Australia, subject to certain conditions. This authorisation is crucial for ensuring that the entity adheres to regulatory standards while offering insurance products, particularly in the niche area of travel insurance. The legislative process ensures that the entity's operations are closely monitored and compliant with the overarching goals of consumer protection and market stability.

Scope and Application

The C2026G00222 authorisation issued under the Insurance Act 1973, by Peter Diamond, a delegate of the Australian Prudential Regulation Authority (APRA), specifically grants Europ Assistance Australia Pty Ltd the authority to engage in insurance business in Australia as of 1 April 2026. This authorisation is strictly confined to the provision of travel insurance, reflecting the specific condition imposed upon the authorisation, as outlined in the attached Schedule. The authorisation applies to Europ Assistance Australia Pty Ltd, a body corporate identified by its Australian Business Number (ABN) 71 140 219 594, and is subject to the broader provisions and regulatory oversight of the Insurance Act 1973. The authorisation is effective throughout Australia, encompassing the Commonwealth, states, and territories, thereby ensuring regulatory compliance across the nation. No exclusions, exemptions, or thresholds are explicitly stated in this particular authorisation, though the terms of the broader Act may include such provisions. The authorisation does not extend its application through subordinate instruments, and a notice of this authorisation must be published in the Gazette.

Key Provisions

The main operative sections of this legislation are subsections 12(2) and 13(1) of the Insurance Act 1973. Subsection 12(2) allows a delegate of the Australian Prudential Regulation Authority (APRA) to authorise a body corporate to carry on insurance business in Australia. Subsection 13(1) permits the imposition of conditions on such authorisation. The legislation specifies that Europ Assistance Australia Pty Ltd (the body corporate) is authorised to carry on insurance business only for the purpose of providing travel insurance. This authorisation is subject to the condition outlined in the Schedule, which was imposed under subsection 13(1) of the Act. The Act imposes several obligations and requirements on Europ Assistance Australia Pty Ltd. Firstly, it must comply with all conditions specified in the authorisation, which in this case, limits its operations to the provision of travel insurance. Secondly, it must adhere to the regulatory framework established by APRA, including any guidelines, standards, or requirements for insurance businesses. The body corporate must also ensure that its operations are conducted in a manner that is consistent with the public interest and the objectives of the Insurance Act 1973. Breach of the conditions specified in the authorisation, or any other provision of the Insurance Act 1973, may lead to various consequences. Under the Act, the body corporate could be subject to administrative penalties, enforcement actions, or even revocation of its authorisation. If the breach involves fraudulent or dishonest conduct, it may also lead to criminal charges. The specific penalties and consequences depend on the nature and severity of the breach, but they can include fines, imprisonment, or both. The Act does not specify maximum penalties in the authorisation itself, but they can be found in the relevant sections of the Insurance Act 1973. Overall, the authorisation grants Europ Assistance Australia Pty Ltd the ability to conduct travel insurance business in Australia, but it also comes with a strict set of conditions and regulatory requirements. Compliance is crucial to avoid the severe civil and criminal consequences associated with breaches of the Insurance Act 1973. This ensures that the insurance business is conducted responsibly and in the best interest of policyholders.
