I, the Hon Jason Clare MP, Minister for Education, hereby authorise, under subsection 34AAB(1) of the Acts Interpretation Act 1901, the Hon Amanda Rishworth MP, Minister for Social Services, to act on my behalf in the performance of any function or duty, or the exercise of any power, that I, as Minister for Education, may perform or exercise under an Act for the period beginning on 17 December 2022 and ending on 4 January 2023.

Dated      9 December 2022

The Hon Jason Clare MP

Minister for Education

Overview

The Acts Interpretation Act 1901 is a foundational piece of Australian legislation that provides rules for the interpretation and operation of Commonwealth Acts and instruments. This Act was enacted to ensure consistency and clarity in the way legislation is understood and applied. The authorisation of the Minister for Social Services to act on behalf of the Minister for Education, as stipulated in this notifiable instrument dated December 2022, addresses the practical need for ministerial flexibility in the performance of duties across different portfolios, particularly during transitional periods or when a minister is otherwise unable to fulfil their responsibilities. This arrangement was introduced to maintain the continuity of government operations and to ensure that critical functions are not interrupted, thereby reflecting the policy objective of efficient and effective governance.

Scope and Application

The Acts Interpretation Act 1901, through the specific authorisation issued by the Hon Jason Clare MP, Minister for Education, provides a framework for the delegation of certain ministerial functions and duties to the Hon Amanda Rishworth MP, Minister for Social Services, for a limited period from 17 December 2022 to 4 January 2023. This delegation allows the Minister for Social Services to act on behalf of the Minister for Education in the performance of any function, duty, or exercise of power under relevant Acts during this specified timeframe. The authorisation is grounded in subsection 34AAB(1) of the Acts Interpretation Act 1901, thereby ensuring that the delegation is legally sound and within the bounds of the statutory authority granted under the Act. The scope of this delegation is confined to the functions and duties pertinent to the Minister for Education, and it does not extend beyond the authorised period or the functions specified by the Minister for Education.

Key Provisions

The main operative sections of the Notifiable Instrument F2023N00141 detail the authorisation given by the Minister for Education, the Hon Jason Clare MP, to the Minister for Social Services, the Hon Amanda Rishworth MP, to perform any function, duty, or exercise any power on behalf of the former during a specified period. This authorisation is granted under subsection 34AAB(1) of the Acts Interpretation Act 1901 and is effective from 17 December 2022 to 4 January 2023. This allows the Minister for Social Services to act in the capacity of the Minister for Education for the defined duration, ensuring continuity in the execution of ministerial duties. The obligations and requirements imposed by the Act on the parties involved are straightforward. The Minister for Education, the Hon Jason Clare MP, formally authorises the Minister for Social Services, the Hon Amanda Rishworth MP, to act on his behalf. This authorisation is specific to the functions, duties, and powers associated with the role of the Minister for Education and is limited to the period specified in the instrument. There are no additional conditions or qualifications mentioned in the authorisation, which implies that the Minister for Social Services can perform all ministerial functions as if she were the Minister for Education during the authorised period. The legislation does not explicitly detail offences, penalties, or consequences for breaches of the authorisation. However, any actions taken by the Minister for Social Services outside the scope of her authorisation or beyond the specified period could potentially lead to legal scrutiny or challenges, as they might be considered ultra vires (beyond the powers). While the document itself does not outline specific penalties, any unauthorised actions might be subject to the general legal consequences applicable to such breaches, which could include legal actions to invalidate the actions taken or other remedies available under the relevant laws.
