Overview

The Wool Use Promotion Act 1945 was enacted to address the need for the promotion and marketing of wool, ensuring that Australia's wool industry could compete effectively on the global market. The Act established the Australian Wool Board, which was tasked with the promotion of wool use and the marketing of wool produced in Australia. The legislation was introduced by the Australian Parliament, reflecting a national policy objective to support and develop the wool industry. The accompanying Statutory Rules of 1951, particularly Statutory Rules 1951 No. 143, were created to provide further detail on the administration and operation of the Act, including the financial compensation for the Board's members and officers, as well as the salaries and allowances for various positions within the Board. These regulations aimed to ensure that the Board could effectively carry out its functions by providing a stable and adequate remuneration structure for its staff.

Scope and Application

The Statutory Rules of 1951, No. 143, made under the Wool Use Promotion Act 1945, govern the regulation of fees, travelling expenses, and salaries of officers within the Australian Wool Board. These regulations apply to the Chairman, members, and officers of the Board, who are engaged in the business of the Board across Australia. The Regulations specify the fees for Chairman and members attending Board meetings or engaged in Board business, the travelling expenses, and the minimum and maximum salaries for various officers within the Board. These provisions are detailed in the inserted Schedule, which outlines the annual salaries and increments for different positions, with additional allowances for certain officers based on age and qualifications. The Regulations extend their application through subordinate instruments, allowing for adjustments in fees, expenses, and salaries as necessary, subject to Ministerial approval and specified tests.

Key Provisions

These regulations, made under the Wool Use Promotion Act 1945, primarily amend the fees, allowances, and salaries of the Chairman and members of the Australian Wool Board, as well as officers of the Board, and update the travelling expenses for Board members (Regulations 1-4). The Chairman and members of the Board are now entitled to a fee of Six pounds six shillings and Five pounds five shillings respectively for each day they attend a meeting or are engaged in Board business (Regulation 3). The travelling expenses for Board members have been updated to Two pounds ten shillings (Regulation 2). Furthermore, the salaries of Board officers are regulated based on the specified minimum and maximum salaries listed in the attached Schedule (Regulation 8). The Schedule provides details on the annual salaries and increments for various positions within the Board, including roles such as Secretary, Accountant, Publicity Director, Clerks, Telephonists, Typists, and Junior Assistants (Schedule). The Act imposes obligations on the Australian Wool Board and its members, including the requirement to attend meetings and engage in Board business as specified (Regulation 3). Additionally, the Board must ensure that officers are paid salaries within the specified range, and that any allowances or increments are subject to the approval of the Minister (Regulation 8 and Schedule). The Board must also ensure that any advancements in salary beyond specified thresholds are subject to the passing of approved tests (Schedule). There are no explicit offences, penalties, or civil/criminal consequences mentioned in these regulations for breach of any provision. However, the regulations do specify that any advancements in salary beyond the stipulated amounts are subject to the passing of approved tests (Schedule). This implies that failure to meet the required standards or conditions for salary advancement could result in the withholding of such increments. The regulations do not specify any maximum penalties for breach, but any non-compliance with the salary provisions could potentially be subject to review or enforcement action under the broader provisions of the Wool Use Promotion Act 1945.
