Commencement.

3. These Regulations shall be deemed to have come into operation on commencement on the tenth day of April, 1946.

By Authority: L. F. JOHNSTON, Commonwealth Government Printer, Canberra.

Overview

The Wool Use Promotion Act 1945 was enacted to address the need for the promotion of wool use in Australia, aiming to enhance the domestic and international market presence of Australian wool. The Act was introduced by the Australian Parliament with a policy objective to ensure the effective promotion and marketing of wool products, which are crucial for the Australian economy. The Statutory Rules of 1948, made under this Act, include amendments to the Australian Wool Board Regulations, specifically targeting the salaries of officers within the Board. These amendments provide for the payment of minimum and maximum salaries to certain officers, contingent on their membership in registered organisations or their status as returned soldiers, and include provisions for applying marginal increases granted to Commonwealth Public Service officers. The Regulations were designed to come into effect on April 10, 1946, with further amendments taking effect from May 1947, ensuring a structured approach to salary adjustments and ensuring fairness and competitiveness in officer remuneration within the Wool Board.

Scope and Application

The Regulations under the Wool Use Promotion Act 1945, as amended, apply to officers of the Australian Wool Board, specifically those occupying positions specified in Table B in the Schedule to these Regulations. These officers include a range of roles such as Clerks, Typists, Machinists, Assistants (Female), Telephonists, and Messengers. The Regulations establish the minimum and maximum salaries for these positions, taking into account the officers’ age and qualifications. The Act applies on a national level as it pertains to Commonwealth legislation. There are no stated exclusions or exemptions within the text; however, the scope of application may be further defined through subordinate instruments. The Act’s application is specifically tailored to officers within the Australian Wool Board and does not extend to other industries or entities unless they fall under the purview of the Australian Wool Board’s operations. The Regulations are set to commence on the tenth day of April, 1946, and any subsequent amendments or marginal increases are to be applied from specified dates as outlined in the text.

Key Provisions

The primary operative sections of these regulations, under the Wool Use Promotion Act 1945, primarily concern amendments to the Australian Wool Board Regulations, particularly focusing on salaries of officers (Reg. 1). Regulation 1 amends Regulation 8 of the Australian Wool Board Regulations, specifying new salary structures and conditions. Sub-regulation (3) stipulates that officers occupying specified offices and who are members of registered organizations or returned soldiers will be paid a minimum salary as outlined in Table B of the Schedule, or a higher salary up to the maximum specified, at the Board's discretion. Sub-regulation (4) allows the Board to apply marginal increases to officers, excluding certain positions, from the first pay period after 28 August 1947, provided that the increases granted under the Arbitration (Public Service) Act 1920-1947 have already been applied. The amendments to the Schedule involve replacing Table A with new salary figures for various officer positions and introducing Table B, which outlines minimum and maximum annual salaries for different office roles and skills levels. The regulations impose specific obligations on the Australian Wool Board, primarily concerning the determination and application of salaries for officers based on their membership in registered organizations or their status as returned soldiers. The Board must ensure that officers meeting these criteria receive their salaries as specified in Table B of the Schedule, or a higher amount up to the maximum salary if determined by the Board. Additionally, the Board is obligated to apply marginal increases to officers, except for those in specific excluded positions, from the first pay period after 28 August 1947, provided that such increases have already been granted under the Arbitration (Public Service) Act 1920-1947. In terms of consequences for non-compliance, the regulations do not explicitly outline offences, penalties, or specific civil or criminal consequences for breach. However, failure to adhere to these salary provisions and obligations could potentially lead to disputes or legal actions by affected officers or organizations, particularly if they believe their entitlements have not been correctly applied as per the regulation's stipulations. The regulations focus more on procedural and administrative compliance rather than punitive measures.
