Overview

The Australian Securities and Investments Commission (Financial Reporting Council – Members) Appointment (No. 1) 2023 was enacted to address the need for expertise and diversity in the Financial Reporting Council, a body responsible for overseeing financial reporting and auditing standards in Australia. This instrument was introduced under the authority of the Treasurer, Jim Chalmers, pursuant to subsections 235A(1) and 235AA(6) of the Australian Securities and Investments Commission Act 2001. The policy objective is to ensure the Financial Reporting Council comprises individuals with the necessary skills and experience to enhance the quality and integrity of financial reporting. By appointing Prudence Bennett and Rachel Grimes on a part-time basis for a period of three years, the legislation aims to bolster the council’s capacity to effectively regulate and oversee financial reporting standards, thereby contributing to the stability and transparency of Australia's financial markets.

Scope and Application

The Australian Securities and Investments Commission (Financial Reporting Council – Members) Appointment (No. 1) 2023 applies to the appointment of Prudence Bennett and Rachel Grimes as part-time members of the Financial Reporting Council (FRC) for a three-year term. This appointment is made under the authority vested in the Treasurer, pursuant to subsections 235A(1) and 235AA(6) of the Australian Securities and Investments Commission Act 2001. The FRC is a statutory body responsible for overseeing the quality of financial reporting in Australia, and its members are instrumental in ensuring that financial reporting standards are maintained and enforced. The appointments are made on a Commonwealth level, extending the reach of the Australian Securities and Investments Commission Act 2001 to include the FRC’s activities. The instrument does not detail any exclusions or exemptions, but its application is bound by the parameters of the Act it references. The scope of the FRC's authority may be further defined or extended through subordinate instruments or regulations, although such details are not explicitly mentioned in this particular notifiable instrument.
