Overview
The Statutory Rules 1926, No. 37, which amend the Australian Rifle Club Regulations under the Defence Act 1903-1918, were enacted to update and refine the existing regulations governing the activities of rifle clubs within the Australian Defence Force. This legislative instrument was introduced to address the need for more precise guidelines and allocation of resources for training and ammunition among active members of these clubs. Enacted by the Governor-General, acting on the advice of the Federal Executive Council, these amendments aimed to streamline certain administrative aspects of the Defence Act, particularly focusing on the provision of ammunition and financial adjustments for club activities. The policy objective behind these amendments was to ensure that the Defence Force's training programs are adequately supported, while also maintaining fiscal responsibility within the allocated budget for these clubs.
Scope and Application
The Australian Rifle Club Regulations, as amended by the Statutory Rules of 1926, No. 37, are issued under the Defence Act 1903-1918. These regulations apply to active members of rifle clubs who are part of the Australian Defence Force, as well as to the clubs themselves, governing their activities and operational standards. The geographic reach of these regulations is national, applying to all rifle clubs within the Commonwealth of Australia. These regulations were designed to ensure that the operational and administrative standards of rifle clubs are consistent with the overall objectives of the Defence Act. The regulations have been amended to adjust the number of rounds allocated to active members upon first enrolment and to modify the fees associated with membership. The changes also include a modification to the timeline for certain administrative actions, specifically extending the deadline for compliance from 30 September to 15 July. These regulations do not specify any exclusions or exemptions, and their application is direct without reliance on subordinate instruments.
Key Provisions
The Regulations under the Defence Act 1903-1918, specifically concerning the Australian Rifle Club, have been amended to refine and clarify certain provisions. Regulation 43, which deals with the allocation of ammunition, now includes a new sub-paragraph (b) that mandates a provision of 100 rounds for each active member on their first enrolment in a rifle club (Reg. 43(b)). This is an amendment from the previous provision, which only referred to a general figure without specifying the context of initial enrolment. Additionally, the fourth line of this regulation now includes a new designation "(a)" before the word "For", likely to better organise and distinguish different types of allocations within the regulation.
Further amendments include changes to Regulation 45, where the figure "100" has been deleted and replaced with "200", likely reflecting an increased allowance or a correction to the previous quantity (Reg. 45). Similarly, the monetary value "£3 15s. 0d." has been adjusted to "£2 10s. 0d." (Reg. 45). These adjustments might indicate a modification in the financial parameters or perhaps a correction of a previously recorded amount.
Regulation 66, which originally set a deadline for a specific action to be completed by "30th September", has been updated to require that the action be completed "not later than the 15th July" (Reg. 66). This change likely aims to expedite a process or ensure that certain activities are concluded in a more timely manner, thereby aligning with other operational timelines or requirements.
These regulations impose specific obligations on the parties involved, such as the provision of ammunition to new members and adjustments in financial allowances. The changes to Regulation 66 require adherence to the new deadline, ensuring that any relevant actions are completed within the specified timeframe. Failure to comply with these regulations could lead to administrative or operational inefficiencies within the rifle club's activities.
The implications of not adhering to these regulations could vary. For instance, not providing the specified ammunition rounds to new members as per Regulation 43(b) might result in non-compliance with the club's operational standards. Similarly, not aligning with the new financial parameters in Regulation 45 could lead to discrepancies in budget allocations. Regulation 66's new deadline is strict, and non-compliance might result in penalties or procedural setbacks. While the regulations do not explicitly state penalties, the importance of adhering to these deadlines and specifications suggests that non-compliance could lead to significant operational repercussions.
