Overview

The Statutory Rules 1927, No. 146, amends the Australian Rifle Club Regulations under the Defence Act 1903-1927. Enacted by the Governor-General in Council, the amendment introduces a modification to Regulation 1a, which now incorporates all amendments to the regulations. This legislative instrument was designed to ensure the Australian Rifle Club Regulations are kept up to date and reflect any changes that may occur. The purpose of this amendment is to streamline the regulation process and provide clear guidance on the application of the Australian Rifle Club Regulations. The amendment came into effect on 19 October 1927, as authorised by the Minister of State for Defence, T. W. Glasgow.

Scope and Application

The Australian Rifle Club Regulations, as amended by Statutory Rules 1927, No. 146, are instrumental in governing the conduct and operations of the Australian Rifle Club under the Defence Act 1903-1927. These regulations apply specifically to the Australian Rifle Club and its members, including their activities and the management of the club's affairs. The scope of the Act is confined to the Commonwealth jurisdiction, thereby affecting entities and individuals within Australia's federal framework. The regulations establish standards and controls pertinent to the activities of the Australian Rifle Club, ensuring they align with the broader objectives of the Defence Act. Notably, the amendment detailed in Statutory Rules 1927, No. 146, extends the regulatory authority to encompass all subsequent amendments to the Regulations, thereby ensuring that the club's operations remain in compliance with any future legislative changes. This legislative instrument ensures that the Australian Rifle Club adheres to the prescribed standards and regulatory requirements set forth by the Commonwealth government.

Key Provisions

The Australian Rifle Club Regulations, as amended by Statutory Rules 1927, No. 146, introduce specific provisions concerning the governance and activities of the Australian Rifle Club (Regulation 1a). This regulation ensures that all amendments to the original regulations are included, providing clarity and comprehensiveness to the legislative framework governing the club. These regulations impose various obligations on the members and officials of the Australian Rifle Club. For example, they may require members to adhere to specific standards of conduct, maintain certain qualifications, and follow protocols related to the use of firearms and participation in shooting events (Regulation 1a). Additionally, the regulations may outline the responsibilities of the club's executive and the procedures for decision-making and governance within the club. Failure to comply with the provisions of the Australian Rifle Club Regulations may result in legal consequences. The specific nature of these consequences can vary depending on the nature and severity of the breach. Offences under these regulations could potentially lead to both civil and criminal penalties. For instance, members found in breach of the regulations might face fines, suspension, or even expulsion from the club. In more serious cases, criminal charges could be brought, leading to prosecution and potential imprisonment, although the exact penalties are not detailed in the legislative text provided. The regulations aim to ensure that the activities of the Australian Rifle Club are conducted in a safe, orderly, and lawful manner, thereby protecting both the members and the public. The outlined obligations and potential consequences serve to maintain the integrity and reputation of the club while ensuring compliance with legal standards. The clear stipulations and consequences underscore the importance of adherence to the regulations by all parties involved.
