Overview

The Australian Research Council Act 2001 was enacted to establish the Australian Research Council (ARC) and to provide a legislative framework for its operation. This Act was designed to address the need for a structured and strategic approach to the allocation of research funding in Australia, ensuring that research efforts are aligned with national priorities and supported by appropriate competitive processes. The Australian Parliament enacted this Act to facilitate high-quality research and innovation, contributing to the economic and social development of the nation. Under section 60 of the Act, the Minister for Innovation, Industry, Science and Research is responsible for approving the ARC funding rules, which include the Special Research Initiatives Funding Rules. These rules, subject to variation as necessary, outline the eligibility criteria, accountability requirements, and other relevant matters for research programs that may receive funding under the National Competitive Grants Program. The policy objective is to support eligible organisations in acquiring research infrastructure, equipment, and facilities that will enhance the quality of high-impact research projects.

Scope and Application

The Special Research Initiatives Funding Rules for funding commencing in 2008-2009 or 2009-2010 Variation (No. 1), made under section 60 of the Australian Research Council Act 2001, governs the eligibility and accountability requirements for research programs funded under the Special Research Initiatives scheme, a part of the Australian Research Council's National Competitive Grants Program. These rules apply to eligible organisations seeking funding for research infrastructure, equipment, and facilities that support high-quality research projects. The rules are approved by the Minister for Innovation, Industry, Science and Research, and the variation to these rules was similarly approved under section 61 of the Act. This variation involved the amendment of acronyms and definitions, as well as the deletion and replacement of certain sections such as Appendix 2, reflecting adjustments to the administrative framework for the scheme. The rules have a national jurisdictional reach as they are part of Commonwealth legislation. The variation came into effect on the day after its registration on the Federal Register of Legislative Instruments, thereby extending the application of the original rules to encompass the specified changes.

Key Provisions

The main operative sections of these Funding Rules (F2009L02868) are those that set out the eligibility criteria, accountability requirements, and other relevant matters for research programs funded under the Special Research Initiatives scheme. These provisions, including the amendment and addition of acronyms and definitions, and the replacement of Appendix 2, are contained in the Special Research Initiatives Funding Rules for funding commencing in 2008-2019 or 2009-2010 Variation (No. 1). These rules were approved by the Minister for Innovation, Industry, Science and Research on 27 May 2009, and they provide for funding to eligible organisations for research infrastructure, equipment, and facilities that will support high-quality research projects. The Special Research Initiatives Funding Rules impose several obligations and requirements on parties and entities governed by them. Firstly, eligible organisations must meet specific eligibility criteria to qualify for funding under the scheme. These criteria may include having a demonstrated track record in research, possessing the necessary research infrastructure, and having a clear plan for using the funding to support high-quality research projects. Secondly, funded organisations must adhere to accountability requirements, which may involve regular reporting on the progress and outcomes of their research projects, as well as maintaining appropriate records and documentation related to the use of funding. Thirdly, the rules may impose requirements related to the management and administration of funded research projects, such as the need for organisations to have appropriate governance structures and risk management processes in place. Breach of the Special Research Initiatives Funding Rules may result in various consequences, including both civil and criminal penalties. For example, failure to comply with the eligibility criteria or accountability requirements may result in the revocation of funding or the imposition of financial penalties. Additionally, breaches of the rules may be subject to investigation and prosecution under the Australian Research Council Act 2001 or other relevant legislation. The maximum penalties for breach of these rules may vary depending on the specific provision breached and the circumstances of the breach, but may include fines, imprisonment, or both. It is important for parties and entities governed by the Special Research Initiatives Funding Rules to be aware of their obligations and to take steps to ensure compliance with the rules to avoid potential consequences.
