Section 60 of the Australian Research Council Act 2001 (the Act) provides that the Minister for Education, Science and Training must approve ARC funding rules.

Purpose and effect

Linkage Learned Academies Special Projects is a scheme funded under the Australian Research Council’s National Competitive Grants Program.  The Linkage Learned Academies Special Projects Funding Rules for funding commencing in 2006 sets out the eligibility and accountability requirements and other relevant matters for research programs which may be funded under this scheme. The scheme funds the Learned Academies and the National Academies Forum to undertake research-related projects which are approved by the Minister for Education, Science and Training.

In accordance with subsection 59 (2) of the Act, the Linkage Learned Academies Special Projects contain:

(a) the eligibility criteria to be met in order for a proposal to be approved for financial assistance (including criteria relating to the kinds of organisation that may receive assistance and the kinds of research program in respect of which assistance may be provided);

(b) how to apply for financial assistance;

(c) the assessment process for deciding which proposals will be recommended for approval;

(d) the ways in which, and circumstances in which, a funding approval may be varied; and

(e) any additional accountability requirements that the ARC Board thinks desirable.

In accordance with subsection 59 (2) of the Act, the Linkage Learned Academies Special Projects Funding Rules for funding commencing in 2006 rules take account of, and are consistent with:

(a) the funding cap for the year, or each of the years, to which the rules apply; and

(b) the funding split determination for the year, or each of the years, to which the rules apply.

The Linkage Learned Academies Special Projects Funding Rules for funding commencing in 2006 were approved by the Minister for Education, Science and Training, the Hon Dr Brendan Nelson MP, on 6 September 2005.  No amendments have been made.

Consultation

On 21 June 2005, the ARC invited comments and feedback from all organisations eligible for ARC funding on funding rules for ARC schemes.  The ARC also met with a number of key higher education institutions known as the ‘Group of Eight’ in the period 11-15 July 2005.  Submissions were received by the ARC from a number of institutions in June/July 2005.  The ARC considered these submissions and, where appropriate, the funding rules approved by the Minister reflected this feedback.

Retrospectivity

This determination has effect from 6 September 2005, the date the Minister for Education, Science and Training, the Hon Dr Brendan Nelson MP approved funding rules for proposals.  Payments may have been made to eligible organisations under the Scheme from this date.  The retrospective commencement of this determination is beneficial to, and does not disadvantage, eligible recipients.

Overview

The Australian Research Council Act 2001, enacted by the Parliament of Australia, addresses the need for structured funding and regulation of research initiatives across the nation. This legislation empowers the Minister for Education, Science and Training to establish and oversee funding rules for competitive grants, ensuring that research projects are adequately supported, evaluated, and managed. The Linkage Learned Academies Special Projects Funding Rules for funding commencing in 2006, approved by the Minister, establish the eligibility criteria, application process, assessment mechanisms, and accountability requirements for research programs under the National Competitive Grants Program. These rules aim to facilitate the funding of research projects by Learned Academies and the National Academies Forum, promoting high-quality research while ensuring compliance with ethical standards and other regulatory requirements. The rules also consider the funding cap and split determination for the specified years, reflecting a commitment to transparent and equitable funding practices.

Scope and Application

The Funding Rules under the Australian Research Council Act 2001, specifically governing the Linkage Learned Academies Special Projects, apply to research programs undertaken by the Learned Academies and the National Academies Forum. These programs must be approved by the Minister for Education, Science and Training. The rules define the eligibility criteria for organisations that may receive funding, including specific types of entities and their roles, as well as the kinds of research programs that qualify for financial assistance. The geographic reach of these rules is national, as they are established under the Commonwealth and apply across Australia. The rules incorporate various criteria, such as the funding cap for the relevant year and the funding split determination, ensuring that the funding allocation aligns with the national priorities. The rules also address the accountability requirements, including ethical standards, intellectual property management, and insurance obligations. The Funding Rules for 2006 came into effect from 6 September 2005, with the aim of providing a clear framework for the administration and distribution of funds for research projects commencing in that year. The rules were developed following consultations with eligible organisations and higher education institutions, ensuring that feedback was incorporated where appropriate.

Key Provisions

The primary sections of the Linkage Learned Academies Special Projects Funding Rules for funding commencing in 2006, as outlined in section 59(2) of the Australian Research Council Act 2001, set forth the eligibility criteria for organisations and research programs seeking financial assistance. These criteria include the types of organisations that can receive funding and the types of research programs that are eligible (Section 5). Section 2 details fundamental principles and requirements, ensuring ethical conduct in research involving humans, avoiding duplication, managing conflicts of interest, and acknowledging Australian Research Council (ARC) support. Section 7 describes the application process, including the requirements and format for applications, certification, submission procedures, and the deadline for applications. The selection and approval process, including the criteria for assessment, the procedure for assessment and selection, and the offer of funding, are detailed in Section 8. The Act imposes several obligations on parties and entities it governs. Firstly, organisations must meet the eligibility criteria specified in Section 5, ensuring they are suitable types of organisations for the research program. They must adhere to ethical research practices as outlined in Section 2, ensuring their research complies with the Joint NHMRC/AVCC Statement and Guidelines on Research Practice and the NHMRC’s National Statement on Ethical Conduct in Research Involving Humans. Additionally, organisations must submit their applications in the required format and by the specified deadline, as detailed in Section 7. Once approved, organisations must comply with the funding agreement terms and conditions, including reporting requirements and any variations to the funding agreement or approval, as outlined in Section 10. The Act also includes provisions for offences, penalties, and consequences for breaches. While the specific penalties are not detailed in the explanatory statement, breaches of ethical conduct in research, failure to comply with the funding agreement, or submission of incomplete or misleading information could result in civil or criminal consequences. Such breaches may lead to the revocation of funding, legal action, or other penalties as determined by the relevant authorities. The retrospective commencement of these rules from 6 September 2005 ensures that any payments made to eligible organisations under the scheme from this date are governed by these provisions.
