Australian Radiofrequency Spectrum Plan Variation 2025 (No. 1)

The Australian Communications and Media Authority (the ACMA) has made the Australian Radiofrequency Spectrum Plan Variation 2025 (No. 1) (the instrument) under section 30 of the Radiocommunications Act 1992 (the Act) and subsection 33(3) of the Acts Interpretation Act 1901 (the AIA).
Section 30 of the Act provides that the ACMA may, by legislative instrument, prepare a spectrum plan. Pursuant to section 30 of the Act, a spectrum plan must divide the spectrum into such number of frequency bands as is considered necessary by the ACMA for the purpose of regulating radiocommunications under the Act. A spectrum plan must also designate one or more bands to be used primarily for the general purposes of defence, and specify the general purpose or purposes for which other bands may be used.
Subsection 33(3) of the AIA relevantly provides that where an Act confers a power to make a legislative instrument, the power shall be construed as including a power exercisable in the like manner and subject to the like conditions (if any) to repeal, rescind, revoke, amend, or vary any such instrument.
Purpose and operation of the instrument
Purpose of the instrument
The instrument amends the Australian Radiofrequency Spectrum Plan 2021 (the Spectrum Plan). As required under section 30 of the Act, the Spectrum Plan divides the radiofrequency spectrum into frequency bands and specifies the purposes for which those bands may be used. This process is referred to as ‘allocation’ of frequency bands to services. The allocation process includes designating services as either primary or secondary services. The main purpose of designating services as either primary or secondary is to assist in interference management. The status of a service is indicated by use of upper case letters for ‘PRIMARY’, and lower case letters for ‘secondary’.
The Spectrum Plan provides the basis for management of the radiofrequency spectrum in Australia. The allocations effected by the Spectrum Plan are prescriptive and the ACMA issues apparatus licences consistently with the Spectrum Plan.
The Spectrum Plan is part of the way Australia’s obligations as a signatory to the Constitution and Convention of the International Telecommunication Union (ITU) are addressed in domestic law. The provisions of the Constitution and Convention are complemented by the Administrative Regulations, including the Radio Regulations, which are binding on all Member States. The Spectrum Plan provides details of the international frequency allocations agreed for the three world regions (in column 1 of the Table of Frequency Band Allocations of the Spectrum Plan). Australia is part of Region 3 (the third sub-column under column 1).
The basis for the structure of the Spectrum Plan is derived from the Table of Frequency Allocations contained in Article 5 of the Radio Regulations. While the Australian allocations are broadly aligned with the ITU requirements for Region 3, some variations do exist. Such variations are subject to the condition that the services do not cause harmful interference to the radio services or communications of other ITU Members that operate in accordance with the provisions of the Radio Regulations, and that the possibility of harmful interference from such services and communications is accepted.
Operation of the instrument
The instrument amends the Spectrum Plan.
The amendments reflect both international and domestic changes.
Changes arising from the ITU World Radiocommunication Conference 2023 (WRC-23) held in Dubai, United Arab Emirates from 20 November to 15 December 2023 are reflected in changes to column 1 of the Table of Frequency Band Allocations (Part 2 of the Spectrum Plan) and International Footnotes to the Table (Part 4 of the Spectrum Plan).
Domestic developments that have led to amendments included in the instrument are as follows:
Inclusion of new subsection 10(12), which applies to the use of frequency bands that are “not allocated” (i.e. frequencies below 8.3 kHz and in the range 275-420,000 GHz). This will enable a permanent solution for access to these frequency bands in lieu of case-by-case access using a decision under section 10(10) of the Spectrum Plan.
changes to subsections 13(3) to 13(6), to expand the scope of how footnotes can be used to describe the use of the spectrum; in particular, these changes enable footnotes to specify an additional or alternate service allocation. These changes ensure that the provisions are consistent with how footnotes are intended to be used in the Spectrum Plan, or indeed in the Radio Regulations where allocation by footnote is well-established.
removal of international footnote 270 from Column 2 in the frequency band 420-430 MHz. There is an inconsistency between international footnote 270 (which provides a secondary amateur allocation in the entire 420-430 MHz band) and the Australian footnote AUS99, which is limited to 420.8-421.2 MHz. The change made aims to remove this inconsistency and reflects the ACMA’s previous planning decision that amateur use of the band is to be limited to 420.8-421.2 MHz to support the increased use of the broader 420-430 MHz frequency range by government services (see Australian footnote AUS98).
addition of a primary allocation to the fixed service in the frequency bands 5600-5620 MHz and 5630-5650 MHz (facilitated by a new Australian footnote AUS107). This is intended to make permanent arrangements to replace a decision previously made under subsection 10(10).
addition of new Australian footnote AUS108 to facilitate land-based earth stations in motion in the frequency bands 27.5-29.1 GHz and 29.5-30 GHz. This addition, along with the addition of international footnote 517B, will make permanent arrangements to replace a decision previously made under subsection 10(10).
Section 28C of the Act requires the ACMA to have regard to any relevant Ministerial policy statements when performing its spectrum management functions, which includes its functions under section 30 of the Act. The ACMA has had regard to the Radiocommunications (Ministerial Policy Statement – 3.4–4.0 GHz) Instrument 2022 in making the instrument. The instrument makes minor changes to some arrangements in parts of the 3400–4000 MHz frequency band (the 3.4 GHz band), largely to reflect the position in other parts of the world. To the extent these changes affect the management of the radiofrequency spectrum in Australia, they help support access to the 3.4 GHz band for a range of use cases and users.
The ACMA and the Minister must only exercise some of their powers under the Act in accordance with, or consistently with, the Spectrum Plan (see sections 31, 32, 39, 39A, 44A, 104 and 137 of the Act).
The instrument is a legislative instrument for the purposes of the Legislation Act 2003 (the LA), and is disallowable. The Spectrum Plan is subject to the sunsetting provisions in Part 4 of Chapter 3 of the LA.

Attachment B provides details of the changes affecting Australia from WRC-23.

Consultation
Before the instrument was made, the ACMA was satisfied that consultation was undertaken to the extent appropriate and reasonably practicable, in accordance with section 17 of the LA.
Section 33 of the Act requires the ACMA to publish a notice on the ACMA’s website stating that a draft of the spectrum plan is available for comment, setting out the draft plan and inviting interested persons to make representations about the draft plan by a date at least one month later than the date on which the notice is published. Such a notice in relation to the instrument was placed on the ACMA’s website on 8 November 2024 inviting representations about the draft instrument by 16 December 2024. Eleven submissions were received during that period from a combination of government agencies and communications industry participants. In making the instrument, and in accordance with the requirements of subsection 33(4) of the Act, the ACMA gave due consideration to the representations received during the consultation period. The ACMA incorporated the changes suggested by the Commonwealth Scientific and Industrial Research Organisation (CSIRO) to better reflect the current operational state and capabilities of radio astronomy in Australia, and to reflect the contemporary name for the site and by adding the Square Kilometre Array Observatory (SKAO) and the Experiment to Detect the Global EoR Signature (EDGES). The ACMA did not adopt other changes suggested by the Bureau of Meteorology in relation to the operation of the Learmonth Solar Observatory (LSO) in several frequency bands, are there is no specific regulatory arrangement in place to support the LSO.
Statement of compatibility with human rights
Subsection 9(1) of the Human Rights (Parliamentary Scrutiny) Act 2011 requires the rule-maker in relation to a legislative instrument to which section 42 (disallowance) of the LA applies to cause a statement of compatibility with human rights to be prepared in respect of that legislative instrument.
The statement of compatibility set out below has been prepared to meet that requirement.

Human rights implications
The ACMA has assessed whether the instrument is compatible with human rights, being the rights and freedoms recognised or declared in the international instruments listed in subsection 3(1) of the Human Rights (Parliamentary Scrutiny) Act 2011.
Having considered the likely impact of the instrument and the nature of the applicable rights and freedoms, the ACMA has formed the view that the instrument does not engage any of those rights or freedoms.
Conclusion
The instrument is compatible with human rights as it does not raise any human rights issues.

Section 1 Name
This section provides for the instrument to be cited as the Australian Radiofrequency Spectrum Plan Variation 2025 (No. 1).
Section 2 Commencement
This section provides for the instrument to commence at the start of the day after the day it is registered on the Federal Register of Legislation.
