Australian Passports Amendment Determination 2007 (No.1)
EXPLANATORY STATEMENT
The Determination seeks to ensure consistency between all elements of personal identity recorded in passports and records held by the originator (i.e. the source) of the cardinal documents, i.e. the Australian birth or citizenship certificates. Schedule 7.2 of the Australian Passports Determination 2005 will be amended to specify the elements of personal information that identify an individual for the purposes of Australian passport issue.
The four elements include the individual’s name, date of birth, gender and place of birth. Australian travel documents only include these details as recorded on the person’s cardinal documents. Responsibility for determining this information does not rest with the Australian Passport Office.
The Department consulted with state-level Registries of Births, Deaths and Marriages and the Department of Immigration and Citizenship.
Section 57 of the Australian Passports Act 2005 gives the Minister for Foreign Affairs the authority to make determinations regarding the issue of travel documents.
The Determination is a legislative instrument for the purpose of the Legislative Instruments Act 2003
