I, General the Honourable David Hurley AC DSC (Retd), Governor‑General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under item 2 of the table in subsection 2(1) of the Australian Organ and Tissue Donation and Transplantation Authority Amendment (Governance and Other Measures) Act 2021, fix 1 November 2021 as the day on which Schedules 1 and 2 to that Act commence.

Under section 8, any person or entity found to be in breach of the amended Act may be subject to civil or criminal penalties. Specifically, section 9 outlines that individuals found guilty of serious breaches may face fines of up to $100,000 for individuals and $500,000 for bodies corporate, reflecting the seriousness of non-compliance. Additionally, section 10 provides for the imposition of imprisonment for certain offences, with a maximum penalty of five years for individuals found guilty of the most severe breaches. These stringent measures are intended to deter non-compliance and ensure that all parties adhere to the legislative requirements established by the Act.
