Overview

The Australian Notes Act 1914 was enacted to amend section six of the Australian Notes Act 1910–1911, aiming to address issues and gaps in the existing legal framework regarding the issuance of Australian notes. This legislation was introduced by the Parliament of the Commonwealth of Australia and received royal assent on 21st December, 1914. The primary objective of this Act is to refine the legal basis for the issuance and circulation of Australian currency, ensuring that the monetary system remains robust and adaptable to the evolving economic environment of the nation. By amending the 1910–1911 Act, this 1914 amendment seeks to improve the clarity and functionality of the legal provisions governing the issuance of Australian notes, thus supporting the overall stability and efficiency of the Australian monetary system.

Scope and Application

The Australian Notes Act 1914 amends the Australian Notes Act 1910-1911, specifically targeting section six. This Act applies to entities involved in the issuance of Australian notes, essentially governing the legal framework within which these notes are produced and circulated. The amendment modifies the stipulations regarding the date on Australian notes, affecting both financial institutions and the general public who use or rely on these notes. Geographically, this Act applies nationally across Australia, reinforcing the uniformity and integrity of currency standards throughout the Commonwealth. However, the Act does not explicitly mention exclusions or exemptions, suggesting that its provisions apply broadly to all entities issuing notes unless otherwise specified by subordinate instruments or specific regulations. Through this legislative amendment, the Act seeks to streamline the legal requirements for the issuance of Australian currency, ensuring consistency and compliance across the financial sector.

Key Provisions

The main operative sections of the Australian Notes Act 1914 (C1914A00023) concern amendments to the Australian Notes Act 1910-1911. Section 3 of the Act specifically modifies section six by omitting the phrase “and bear date at” from paragraph (a) of subsection (1). This amendment likely alters the conditions under which Australian notes can be issued or circulated, but the exact nature of the change is not specified in the provided text. The obligations and requirements imposed by this Act on the parties or entities it governs are primarily focused on ensuring that any changes to the issuance and circulation of Australian notes are legally compliant. By amending section six of the Australian Notes Act 1910-1911, this Act likely imposes a duty on relevant authorities to ensure that any modifications to the legal framework are properly documented and implemented. The omission of the specified words from subsection (1) of section six suggests a simplification or a broadening of the criteria under which Australian notes can be issued, but the specific implications would require further examination of the original and amended texts. The Australian Notes Act 1914 (C1914A00023) does not explicitly state any new offences, penalties, or civil/criminal consequences for breach within the provided text. However, any failure to comply with the amended requirements could potentially lead to legal disputes or challenges regarding the validity of Australian notes issued under the new provisions. Given that this Act amends an existing piece of legislation, it is prudent for practitioners to consider the broader implications of the changes and ensure that any actions taken are in accordance with the updated legal framework. The absence of specific penalties in the text does not negate the potential for legal repercussions in case of non-compliance.
