Overview
The Australian National University Academic Board and Committees Rules 2013 were enacted to provide a structured framework for the establishment, constitution, functions, and powers of the committees and subcommittees within the Australian National University. This legislative instrument was made under the authority of the Australian National University Academic Board Statute 2013, specifically section 11, and was approved by the Council of the University at its meeting on 15 February 2013. The Rules were designed to ensure effective governance and administrative efficiency by clearly delineating the roles and responsibilities of various committees within the university. It was determined that the retrospective commencement of these Rules would not adversely affect the rights or disadvantage any individuals, aligning with the provisions of the Legislative Instruments Act 2003.
Scope and Application
The Australian National University Academic Board and Committees Rules 2013, established under the authority of the Australian National University Academic Board Statute 2013, section 11, outlines the framework for the establishment, constitution, functions, and powers of committees and subcommittees within the Australian National University. This legislation applies to all committees and subcommittees within the university, ensuring that their operations are governed by a clear and structured set of rules. The Rules came into effect on 15 February 2013, with the approval of the Council of the University at its meeting held on the same date. The University has confirmed that the retrospective application of the Rules will not adversely affect any individuals' rights or disadvantage those covered by the provisions. Additionally, as there are no documents incorporated by reference in these Rules, the governance and operational clarity is maintained solely within the text of the legislation. This ensures that the university's academic and administrative functions are effectively managed through well-defined committee structures.
Key Provisions
The Australian National University Academic Board and Committees Rules 2013 (the "Rules") establish the framework for the governance of the Academic Board and various committees within the university. The Rules are structured to provide clear guidelines on the establishment, constitution, functions, and powers of the Academic Board and its committees (section 1). These provisions ensure that the Academic Board operates within a defined structure, maintaining a consistent and systematic approach to academic governance. The Rules also detail the procedures for the formation and operation of subcommittees, ensuring that they are aligned with the overarching objectives of the Academic Board (section 2).
Under the Rules, the Academic Board and its committees are tasked with a range of responsibilities that include academic policy development, curriculum oversight, and the appointment of academic staff. The Rules mandate that the Academic Board must be constituted in accordance with the specified requirements, including the number and types of members, their terms of office, and the procedures for their election or appointment (section 3). Furthermore, the Rules stipulate that committees must be established to address specific academic functions, and these committees are to operate under the direction and oversight of the Academic Board (section 4). This ensures that all academic activities are governed by appropriately constituted bodies with defined scopes of responsibility.
Breaches of the Rules may result in various consequences, including the potential for disciplinary action against members of the Academic Board or committees who fail to adhere to the prescribed procedures. While the Rules themselves do not explicitly outline specific offences or penalties, violations of the Rules could lead to internal university disciplinary measures, which might include warnings, suspension, or termination of office. Additionally, any actions taken by the Academic Board or its committees that are not in compliance with the Rules may be subject to review or reversal by higher university authorities, thereby affecting the legitimacy and effectiveness of those actions.
The Rules also incorporate a requirement for transparency and accountability, ensuring that all decisions made by the Academic Board and its committees are documented and can be audited. This provision is critical in maintaining the integrity of the academic governance structure and ensuring that the university adheres to its statutory obligations. By providing a clear framework for the operation of the Academic Board and its committees, the Rules help to safeguard the academic standards and operations of the university, ensuring they are conducted in a fair, consistent, and legally compliant manner.
