Overview
The Australian National Airlines Commission Retention Act 1984 was enacted to address the gap left by the repeal of the Australian National Airlines Repeal Act 1981, thereby ensuring the continued existence and operations of the Australian National Airlines Commission. The Act was assented to on 25 June 1984 and received Royal Assent, coming into operation on the same day. This legislative action was taken by the Queen, in conjunction with the Senate and the House of Representatives of the Commonwealth of Australia, to maintain the administrative framework necessary for the functioning of the Australian National Airlines Commission. The policy objective of the Act is implicitly to preserve the institutional continuity and governance structure of the national airline, facilitating its ongoing operations and ensuring the stability of the aviation sector within Australia.
Scope and Application
The Australian National Airlines Commission Retention Act 1984 applies to the functions and operations of the Australian National Airlines Commission, ensuring its continued existence and responsibilities following the repeal of the Australian National Airlines Repeal Act 1981. The Act is of Commonwealth jurisdiction, impacting entities and persons involved in the administration and operation of the Australian National Airlines Commission. Its geographic reach encompasses the entire nation, as it pertains to federal matters within Australia. The Act does not specify particular exclusions, exemptions, or thresholds in its primary text, but it is possible that further details and clarifications may be provided through subordinate instruments. This Act effectively reinstates the Commission, thereby extending its application to cover the specific functions and duties previously defined under the repealed legislation.
Key Provisions
The Australian National Airlines Commission Retention Act 1984 (section 1) establishes the short title of the Act, which is the Australian National Airlines Commission Retention Act 1984. This Act came into operation on the day it received Royal Assent (section 2). Notably, the Act also repeals the Australian National Airlines Repeal Act 1981 (section 3), indicating a legislative update or replacement.
The Act imposes several obligations and requirements on the entities it governs. While the Act itself is relatively brief and does not detail specific provisions in depth, its primary purpose appears to be the retention of the Australian National Airlines Commission, likely ensuring that certain administrative or operational structures remain in place following the repeal of previous legislation. This could entail maintaining the commission’s functions, staff, or operational guidelines as previously established.
In terms of potential breaches and legal consequences, the Act itself does not explicitly outline specific offences, penalties, or consequences for non-compliance. Given that the Act focuses on legislative repeal and the retention of a commission, it is possible that any non-compliance or administrative failures would be addressed under broader administrative or public service laws in Australia. However, it is important to note that while the Act does not provide explicit penalties within its text, the failure to adhere to retained obligations could potentially lead to administrative or legal scrutiny, especially if it affects the operation or objectives of the Australian National Airlines Commission.
In summary, the Australian National Airlines Commission Retention Act 1984 repeals the Australian National Airlines Repeal Act 1981 and ensures the continuation of the Australian National Airlines Commission. It imposes obligations related to the retention and operational continuity of the commission but does not specify detailed penalties for non-compliance within its text. Any resulting legal consequences would likely be addressed under broader administrative frameworks.
