STUDENT DISCIPLINARY RUles

 

 

EXPLANATORY STATEMENT

 

 

 

  1.      Authority for making the instrument:  

 

The Maritime College Act 1978 section 24 authorises AMC Council to make Statutes not inconsistent with the Act.   A Statute may provide for empowering any authority (including the Council) or officer of the College to make rules, not inconsistent with the Act or the Statute, for carrying out or giving effect to the Statute.

 

Australian Maritime College  Statute No. 2 General Management Statute - authorises AMC Council to make rules relating to management, good government  and discipline, the discharge of debts and the operation of facilities.

 

2. Purpose and operation of the instrument:

 

The Rules specify

(1) the powers of teaching staff, nominated managers of academic support facilities or any senior administrative manager to take action in the event of serious student misconduct on campus;

(2) the powers of the Registrar to make enquiries and take further action;

(3) the constitution and role of the Disciplinary Committee;

(4) the powers of the President and Principal with respect to the recommendations of the Disciplinary Committee; and

(5) the power to take consequential actions.

 

This document repeals the Student Disciplinary Rules made on 16 September 1999 and makes the following rules, containing minor changes for practical administrative purposes.  These changes relate to the powers of staff (managers of academic support facilities and any senior administrative manager included) and extend the time frames for relevant actions from 48 hours to three business days.

3.         Consultation process: 

 

Senior administrative staff were consulted with respect to the required changes.   The revised Rules were approved by AMC Council.
