Overview

The Australian Institute of Multicultural Affairs (Remuneration and Allowances) Regulations, enacted in 1980, were made under the Australian Institute of Multicultural Affairs Act 1979. The primary purpose of this legislation is to provide for the payment of remuneration and allowances to the Director of the Australian Institute of Multicultural Affairs, ensuring that the role is appropriately compensated. The enacting body in this instance is the Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council. These regulations are designed to establish the financial framework for the Director’s position, taking into account any relevant determinations made by the Remuneration Tribunals Act 1973. The policy objective is to support the effective functioning of the Institute by ensuring that the Director is adequately remunerated for their duties.

Scope and Application

The Australian Institute of Multicultural Affairs (Remuneration and Allowances) Regulations provide a clear framework for the financial compensation of the Director of the Australian Institute of Multicultural Affairs, establishing specific remuneration and allowances to which the Director is entitled. These Regulations apply directly to the Director of the Institute and are formulated to ensure that the compensation aligns with the duties and responsibilities associated with the role. The remuneration and allowances are subject to any determinations made by the Remuneration Tribunal under the Remuneration Tribunals Act 1973, thereby ensuring compliance with broader federal standards for public sector remuneration. Geographically, these Regulations operate within the Commonwealth of Australia, reflecting the national scope of the Institute's responsibilities and the federal legislative authority governing its operations. The Regulations do not explicitly state exclusions or exemptions, nor do they establish thresholds beyond the specified rates of remuneration and allowances. The application of these Regulations is limited to the Director of the Australian Institute of Multicultural Affairs, with no extension to other personnel or entities within the Institute or beyond.

Key Provisions

The Australian Institute of Multicultural Affairs (Remuneration and Allowances) Regulations, 1980, provide specific details about the remuneration and allowances for the Director of the Australian Institute of Multicultural Affairs. Section 2 states that the Director is to be paid a yearly remuneration of $35,156, subject to any determination made under the Remuneration Tribunals Act 1973. Section 3 outlines an additional yearly allowance of $1,300 for the Director. Furthermore, Section 4 stipulates that if the Director is required to travel for work purposes and must stay away overnight from their usual place of residence, they are entitled to a daily travelling allowance of $53 for the duration of the absence. These provisions ensure that the Director is appropriately compensated for their duties. The Regulations impose several obligations on the parties involved. The primary obligation is on the Australian government to ensure that the Director receives the specified remuneration and allowances as per Sections 2 and 3. Additionally, the Director must be compensated for travel expenses if they are required to stay away from home for work, as stipulated in Section 4. These obligations ensure that the Director's financial needs are met while they perform their duties. While the Regulations themselves do not explicitly outline specific offences, penalties, or consequences for breaches, the underlying Act, the Australian Institute of Multicultural Affairs Act 1979, may provide for such provisions. Typically, non-compliance with the terms of employment, including remuneration and allowances, could result in legal action under employment law. However, the Regulations themselves do not specify any particular penalties or consequences for breaches. The overarching legislative framework would need to be consulted to understand any potential legal ramifications of failing to adhere to the prescribed remuneration and allowances.
