Overview
The Australian Federal Police Regulations 1981 (Amendment) were enacted to address the need for a regulatory update to align with changes within the Australian Federal Police Act 1979. The Australian Federal Police Act, which established the Australian Federal Police, required amendments to ensure the regulatory framework kept pace with evolving operational needs and structural changes within the police force. This legislative instrument was created under the authority of the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, to provide the necessary updates to the existing regulations. The specific policy objective of this amendment was to clarify and expand the ranks subject to certain provisions of the Act, particularly with respect to disciplinary actions and oversight as outlined in section 64A of the Australian Federal Police Act 1979. The introduction of this regulation aimed to maintain effective governance and accountability within the Australian Federal Police.
Scope and Application
The Australian Federal Police Regulations, as amended, apply to the ranks listed in the inserted regulation, specifically declaring that certain ranks within the Australian Federal Police and the Protective Service are subject to section 64A of the Australian Federal Police Act 1979. This regulation applies to individuals holding the specified ranks within these components, thereby extending certain provisions to these personnel. The jurisdictional reach of this regulation is inherently limited to the Commonwealth, aligning with the legislative framework of the Australian Federal Police Act 1979, which governs the operations and conduct of the Australian Federal Police and its associated components. There are no explicit exclusions, exemptions, or thresholds mentioned in this particular amendment; however, the broader application of the Act and its regulations may be subject to further delineation through subordinate instruments or specific provisions within the Act itself. The regulation effectively updates the ranks to which section 64A applies, ensuring that the specified provisions are consistently and accurately enforced across the relevant personnel within the Australian Federal Police and the Protective Service.
Key Provisions
The Australian Federal Police Regulations (Amendment) 1981 introduce new provisions under the Australian Federal Police Act 1979. Specifically, Regulation 40 declares certain ranks within the Australian Federal Police (AFP) to which section 64A of the Act applies (reg. 40). This section pertains to the disciplinary powers and procedures relevant to these ranks. The ranks listed include Constable, Protective Service Constable, Sergeant, Protective Service Sergeant, Senior Sergeant, Protective Service Senior Sergeant, and Station Sergeant. These declarations ensure that specific disciplinary provisions are applicable to these ranks, thereby formalising the scope of section 64A.
The obligations imposed by these regulations on the parties governed include adherence to the disciplinary measures outlined in section 64A of the Act for the specified ranks. The AFP and its members in the listed ranks must comply with the disciplinary procedures and standards set forth in the Act, ensuring that any misconduct or breaches of discipline are handled in accordance with the law. This includes the requirement for proper investigation, notification, and potential disciplinary action against members found to be in breach of the Act.
Failure to comply with the disciplinary provisions set out in section 64A can lead to various consequences. Breaches of these provisions may result in disciplinary actions being taken against the offending member, which could range from reprimands to more severe penalties such as suspension or termination of employment. While the specific penalties for breaches are not detailed in the regulations, the Act generally allows for significant consequences for serious misconduct. In the most severe cases, criminal charges may also be brought against the member, leading to potential fines or imprisonment, depending on the nature and severity of the offence.
