Australian Federal Police (Discipline)

Regulations (Amendment)

The purpose of these amendments to the Australian Federal Police (Discipline) Regulations is to fully and explicitly apply the Australian Federal Police (AFP) disciplinary system to non-police staff members as well as the police members of the AFP. Currently, this is not consistently explicit and the proposed amendments will remove any doubt.

Notes on individual clauses are set out below:

Regulation 1 defines the ‘Principal Regulations’ to mean the Australian Federal Police (Discipline) Regulations.

Regulation 2 adapts subregulation (2) of regulation 4 of the Principal Regulations which deals with absence from duty, to apply fully and explicitly to staff members as well as members.

Regulation 3 adapts paragraph (1)(b) of regulation 12 of the Principal Regulations which deals with malingering, to apply fully and explicitly to staff members as well as members.

Regulation 4 adapts regulation 15 of the Principal Regulations which deals with the soliciting of gifts by members or staff members, to apply fully and explicitly to staff members as well as members.

Regulation 5 adapts paragraph (5)(a) of regulation 20 of the Principal Regulations, which makes provision for suspension from duty, to apply fully and explicitly to staff members as well as members.

Regulation 6 adapts regulation 21 of the Principal Regulations which deals with the hearing of disciplinary proceedings before the Commissioner, to apply fully and explicitly to staff members as well as members.

Regulation 7 adapts paragraph 3(a) of regulation 22 of the Principal Regulations which deals with penalties for breaches of disciplinary offences, to apply fully and explicitly to staff members as well as members.
