Overview

The Australian Capital Territory Tax (Purchases of Marketable Securities) Regulations 1969 were enacted to provide the necessary administrative framework for the taxation of purchases of marketable securities within the Australian Capital Territory, as authorised under the Australian Capital Territory Tax (Purchases of Marketable Securities) Act 1969. These regulations were made by the Governor-General in accordance with the Federal Executive Council’s advice and came into operation on the first day of July 1969. The primary objective of these regulations is to establish the prescribed stock exchanges and exempt authorities relevant to the taxation of marketable securities. The regulations delineate specific stock exchanges that are recognised for tax purposes and list the Commonwealth and Territory authorities that are exempt from tax on the purchase of marketable securities. This legislative instrument was essential in formalising the tax administration framework, ensuring compliance and efficient tax collection within the specified jurisdiction.

Scope and Application

The Australian Capital Territory Tax (Purchases of Marketable Securities) Regulations, which were established under the Australian Capital Territory Taxation (Administration) Act 1969 and the Australian Capital Territory Tax (Purchases of Marketable Securities) Act 1969, apply to the regulation of tax on the purchase of marketable securities within the Australian Capital Territory. These Regulations primarily target entities and persons involved in transactions involving marketable securities, ensuring compliance with the specified tax obligations. The geographic scope of these Regulations is confined to the Australian Capital Territory, governing transactions that occur within its jurisdiction. While the Regulations aim to impose tax on purchases of marketable securities, certain authorities and entities listed in the Second Schedule of the Regulations are exempt from this tax. Additionally, the First Schedule identifies specific stock exchanges that are considered prescribed stock exchanges for the purposes of the Act. The application of these Regulations can be further extended or modified through subordinate instruments, allowing for adjustments to the prescribed stock exchanges or the list of exempt authorities as required.

Key Provisions

The Australian Capital Territory Tax (Purchases of Marketable Securities) Regulations detail the operation and tax requirements for the purchase of marketable securities within the Australian Capital Territory. These regulations, which commenced on 1 July 1969, and Regulation 3 on the date of their publication in the Gazette, serve as a legislative framework to administer tax obligations under the Australian Capital Territory Tax (Purchases of Marketable Securities) Act 1969. Regulation 3 identifies prescribed stock exchanges, including exchanges such as the Auckland Stock Exchange and the New York Stock Exchange, while Regulation 4 lists authorities that are exempt from tax on purchases of marketable securities, such as the Australian Atomic Energy Commission and the Australian Broadcasting Commission. The Regulations impose specific obligations on entities involved in the purchase of marketable securities. They require that purchases made on prescribed stock exchanges be subject to the tax provisions set out in the Act, unless exempt under Regulation 4. Additionally, entities must ensure compliance with these provisions by adhering to the specified schedules and not engaging in activities that would fall outside the scope of prescribed stock exchanges and exempt authorities. Failure to comply with these Regulations can result in legal consequences. The Act itself may outline the penalties for non-compliance, which could include fines or other sanctions. Although the specific penalties are not detailed in the Regulations, it is implied that breaches could lead to enforcement actions as prescribed by the Australian Capital Territory Tax (Purchases of Marketable Securities) Act 1969. This might involve both civil and criminal penalties, depending on the nature and severity of the breach. The intent of these consequences is to ensure that all taxable transactions are properly reported and taxed according to the established legal framework.
