AUSTRALIAN CAPITAL TERRITORY CLASS 2 GENERAL B-DOUBLE EXEMPTION NOTICE 2010 AMENDMENT NOTICE 2015 (No.1)

Purpose

This Notice amends Schedule 2 of the Australian Capital Territory Road Transport (Mass, Dimension and Loading) General B-Double Exemption Notice 2010 (No. 1) to update the road network available to vehicles operating under that Notice.

Note: the Australian Capital Territory Road Transport (Mass, Dimension and Loading) General B-Double Exemption Notice 2010 (No. 1) is a Notice made under ACT law (Notifiable instrument NI2010–102) before the commencement of the Heavy Vehicle National Law (HVNL), but which continues to have force under the HVNL.

2. Authorising Provisions

This notice is made under s138, and section 23 of Schedule 1, of the Heavy Vehicle National Law (HVNL).

3. Commencement

This notice commences on the date it is published.

4. Title

This notice may be cited as the Australian Capital Territory Class 2 General B-Double Exemption Notice 2010 Amendment Notice 2015 (No. 1).

5. Amendment

This notice amends the Australian Capital Territory Road Transport (Mass, Dimension and Loading) General B-Double Exemption Notice 2010 (No. 1) by omitting Schedule 2 of that Notice and inserting the Schedule 2 provided in Appendix 1 of this amendment Notice.

Operators to which this notice applies must conduct a route assessment to determine the most suitable route to access the ACT Motor Vehicle Registry and the listed services stations.
Route assessments must be approved by the Road Transport Authority.
Operation on these routes is not permitted at the following times:

Monday to Thursday: 7.00am to 9.00am and 4.00pm to 6.30pm;

Friday: 7.00am to 9.00am and 4.00pm to 10.00pm;

Saturday: 9.00am to midday.

Overview

The Australian Capital Territory Class 2 General B-Double Exemption Notice 2010 Amendment Notice 2015 (No. 1) was enacted to update the road network available to vehicles operating under the Australian Capital Territory Road Transport (Mass, Dimension and Loading) General B-Double Exemption Notice 2010 (No. 1), a notice made under ACT law before the commencement of the Heavy Vehicle National Law (HVNL). This amendment was made under sections 138 and 23 of Schedule 1 of the HVNL and came into effect on the date of publication. The primary objective of this Notice is to provide a more detailed and updated list of routes and areas where Class 2 General B-Double vehicles are permitted, while also addressing specific restrictions to manage traffic flow and safety, particularly during peak hours and on particular days of the week. Scope and Application

This legislation, the Australian Capital Territory Class 2 General B-Double Exemption Notice 2010 Amendment Notice 2015 (No. 1), amends the Australian Capital Territory Road Transport (Mass, Dimension and Loading) General B-Double Exemption Notice 2010 to update the road network available to vehicles operating under that exemption. The Notice applies to vehicles covered by the specified exemption, particularly Class 2 heavy vehicles, within the Australian Capital Territory. The scope of the amendment focuses on providing detailed routes and areas where such vehicles can operate, along with specific conditions and restrictions applicable to certain roads and times. The amendment does not extend to other types of heavy vehicles or other territories. The Notice operates under the Heavy Vehicle National Law (HVNL) and is effective from the date of its publication.
