Overview
The Australian Animal Health Council (Livestock Industries) Funding Amendment Act 1997 was enacted by the Parliament of Australia to amend the Australian Animal Health Council (Livestock Industries) Funding Act 1996. The primary objective of this amendment was to address the funding mechanisms for the Australian Animal Health Council and related livestock industries, ensuring that the necessary resources were available to manage and protect animal health effectively. This legislative change was aimed at refining and enhancing the financial framework supporting livestock health initiatives across the nation, thereby contributing to the overall health and productivity of the livestock sector.
The Act received Royal Assent on 23 June 1997 and came into effect on the same day. It specifically modifies the original funding act by inserting a new definition under Section 3, related to the Australian Animal Health Council levy, and references the Dairy Produce Levy (No. 1) Act 1986. The amendments are detailed in Schedule 1 of the Act, which outlines the changes to be made to the Australian Animal Health Council (Livestock Industries) Funding Act 1996. This amendment underscores the commitment to improving the legislative support for livestock health and industry funding.
Scope and Application
The Australian Animal Health Council (Livestock Industries) Funding Amendment Act 1997 is a legislative measure that seeks to amend the Australian Animal Health Council (Livestock Industries) Funding Act 1996. This Act applies to the Australian Animal Health Council and the livestock industries, aiming to modify the funding mechanisms for animal health initiatives within these sectors. The Act's amendments primarily focus on the adjustments to the Australian Animal Health Council levy, as specified in the Schedule 1. The amendments concern the Dairy Produce Levy (No. 1) Act 1986, particularly subsection 9(1) in relation to paragraph 5(1)(g), indicating its relevance to the dairy industry's funding obligations. The Act's jurisdiction extends federally across Australia, as it is enacted by the Parliament of Australia and applies nationwide. There are no stated exclusions or exemptions within the text, though the specific impact on entities and individuals would depend on the detailed changes outlined in the Schedule 1. The Act's application can be extended or further specified through subordinate instruments, as is common with legislative amendments.
Key Provisions
The Australian Animal Health Council (Livestock Industries) Funding Amendment Act 1997 (section 3) amends the definition of the Australian Animal Health Council levy under the Australian Animal Health Council (Livestock Industries) Funding Act 1996. Specifically, it inserts a new definition related to the Dairy Produce Levy (No. 1) Act 1986, subsection 9(1), as it pertains to paragraph 5(1)(g). This amendment ensures that the levy includes certain financial aspects of the dairy industry, which were previously not covered under the original Act.
The obligations and requirements imposed by the amended Act primarily revolve around the updated definition of the levy. This means that the Australian Animal Health Council must now consider additional financial parameters when determining the amount of the levy. The amendment ensures that the levy is more comprehensive, reflecting a broader scope of the livestock industries, including dairy produce. This is essential for maintaining the health and safety standards of livestock industries across Australia.
In terms of consequences for non-compliance, the Act does not explicitly state any specific offences or penalties for breach. However, under the Australian Animal Health Council (Livestock Industries) Funding Act 1996, failure to comply with the levy requirements could potentially lead to civil or administrative penalties. These could include fines or other enforcement actions taken by the relevant authorities to ensure compliance with the levy provisions.
While the Australian Animal Health Council (Livestock Industries) Funding Amendment Act 1997 does not explicitly outline penalties, the overarching Act it amends, the Australian Animal Health Council (Livestock Industries) Funding Act 1996, does provide a framework for enforcement. This includes the imposition of fines and other legal measures to ensure that the levy is correctly applied and collected. The specific maximum penalties would depend on the nature and severity of the non-compliance, as outlined in the original Act.
