Overview
The ASIC Superannuation (Notification of variation of disqualification order—Kylie Ai Wui Wee) Instrument 2024/708I was enacted to address the need for transparency and compliance in the supervision of approved Self-Managed Superannuation Fund (SMSF) auditors. This notifiable instrument was made under the authority of Phillip Mines, a delegate of the Australian Securities and Investments Commission (ASIC). The purpose of this instrument is to communicate a variation to a previous disqualification order concerning Kylie Ai Wui Wee, an approved SMSF auditor, pursuant to the Superannuation Industry (Supervision) Act 1993 (the Act). The policy objective is to ensure that the disqualification order is effectively communicated and implemented to maintain the integrity of the superannuation industry. The instrument revokes the earlier disqualification order with effect from 27 August 2024 and imposes a suspension of Ms Wee's registration as an approved SMSF auditor for a period of three years and three months, starting from 19 September 2024.
Scope and Application
The ASIC Superannuation (Notification of Variation of Disqualification Order—Kylie Ai Wui Wee) Instrument 2024/708I applies specifically to Kylie Ai Wui Wee, altering her disqualification from being an approved SMSF auditor as initially ordered by the Australian Securities and Investments Commission (ASIC) on 7 June 2024. The variation of this order, effective from 27 August 2024, revokes the previous disqualification but imposes a suspension of Ms Wee’s registration as an approved SMSF auditor for a period of three years and three months, commencing on 19 September 2024. This instrument operates under the authority of the Superannuation Industry (Supervision) Act 1993 and extends across the Commonwealth of Australia, impacting Ms Wee’s professional conduct and transactions within the superannuation industry. The specific terms of the variation are outlined under subsections 130F(2) and 344(4) of the Act, and the instrument does not specify any exclusions, exemptions, or thresholds beyond those detailed within the Act itself.
Key Provisions
The ASIC Superannuation (Notification of variation of disqualification order—Kylie Ai Wui Wee) Instrument 2024/708I primarily modifies an earlier disqualification order against Kylie Ai Wui Wee (Ms Wee) under the Superannuation Industry (Supervision) Act 1993 (the Act). Specifically, section (a) revokes the disqualification order issued on 7 June 2024, which had prohibited Ms Wee from being an approved SMSF auditor, effective from 27 August 2024. Section (b) suspends Ms Wee’s registration as an approved SMSF auditor for a period of three years and three months, beginning on 19 September 2024. This modification is pursuant to the powers granted under subsection 344(4) of the Act.
The Act imposes specific obligations on Ms Wee as a result of this variation. Firstly, despite the revocation of her disqualification, Ms Wee must adhere to the conditions of her suspension. This means she cannot act as an approved SMSF auditor until her suspension period ends. Secondly, she must comply with any additional conditions or requirements that ASIC may impose during this suspension period. Failure to comply with these obligations could result in further penalties or actions by ASIC.
There are potential consequences for breaching the terms of this variation. Under the Act, any failure to comply with the conditions of Ms Wee’s suspension could result in further disciplinary action by ASIC, including additional suspension or revocation of her registration. While the specific penalties for such breaches are not detailed in this instrument, they could include both civil and criminal sanctions, depending on the nature and severity of the breach. The maximum penalties for contraventions under the Act can be substantial, reflecting the importance of compliance in the superannuation industry.
