Overview

The ASIC Superannuation (Notice of disqualification—Kristian Convery) Instrument 2024/370I, enacted by Craig Angove, a delegate of the Australian Securities and Investments Commission, is a notifiable instrument under the Superannuation Industry (Supervision) Act 1993. This legislation was introduced to address the issue of ensuring the integrity and reliability of approved Self-Managed Superannuation Fund (SMSF) auditors. The policy objective behind the enactment of this instrument is to maintain the trust and confidence of the public in the superannuation industry by disqualifying individuals who do not meet the necessary standards and qualifications. The instrument provides a formal notice to Kristian Convery, an approved SMSF auditor, of his disqualification effective from 15 May 2024, thereby enforcing the provisions of the Superannuation Industry (Supervision) Act.

Scope and Application

The ASIC Superannuation (Notice of disqualification—Kristian Convery) Instrument 2024/370I is a notifiable instrument issued by Craig Angove, a delegate of the Australian Securities and Investments Commission (ASIC), under the Superannuation Industry (Supervision) Act 1993. This instrument applies specifically to Kristian Convery, an approved SMSF auditor with the registration number 100199611, by disqualifying him from holding this position, effective from 15 May 2024. The disqualification order is made under subsection 130F(2) of the Act, which pertains to the powers of ASIC in relation to the supervision of the superannuation industry. The geographic and jurisdictional reach of this instrument is governed by the national application of the Superannuation Industry (Supervision) Act 1993, which applies across Australia, including all states and territories. There are no specific exclusions, exemptions, or thresholds mentioned in this instrument, and its application is direct without extension or restriction through subordinate instruments.

Key Provisions

The ASIC Superannuation (Notice of disqualification—Kristian Convery) Instrument 2024/370I, issued under subsection 130F(5) of the Superannuation Industry (Supervision) Act 1993, includes a disqualification order that effectively bars Kristian Convery, an approved SMSF auditor with registration number 100199611, from performing his role as of 15 May 2024. This order, dated 8 May 2024 and signed by Craig Angove as a delegate of the Australian Securities and Investments Commission, is a critical component of the legislation aimed at maintaining the integrity of the superannuation industry. The document clearly states that the disqualification is a result of the provisions under subsection 130F(2) of the Act, which empowers the ASIC to take such action against individuals deemed unfit for the role. Under this instrument, the primary obligation imposed on Kristian Convery is to cease any activities as an approved SMSF auditor from the effective date of the disqualification order. This means that he cannot provide any auditing services related to self-managed superannuation funds (SMSFs). The order also mandates that Convery must notify any clients or employers of his disqualification and ensure that his cessation of duties does not disrupt ongoing audit processes. Furthermore, there is an obligation on Convery to comply with any further directions or requirements set by the ASIC, including potentially participating in any appeal processes or reviews of the disqualification. The legislation outlines severe consequences for non-compliance with the disqualification order. Any breach of this order can lead to civil or criminal penalties. Under the Superannuation Industry (Supervision) Act 1993, individuals found to be in violation of a disqualification order may face fines and potential imprisonment. The specific penalties, including maximum fines and prison terms, are determined by the severity of the breach and the discretion of the court. Additionally, continued practice as an SMSF auditor post-disqualification can result in further penalties, including higher fines and extended periods of imprisonment, as well as potential restitution orders to compensate affected parties. These stringent measures are designed to enforce compliance and uphold the regulatory standards of the superannuation industry.
