EXPLANATORY STATEMENT

Archives Regulations (Amendment)

(Issued under the authority of the Minister of State for Home Affairs)

Section 34(8)(c) of the Archives Act 1983 (the Act) provides that a Minister may, either generally or as otherwise provided by instrument of delegation, by writing signed by him, delegate all or any of his powers under this section, other than this power of delegation, to the person holding, in relation to a Commonwealth institution that is not a prescribed authority for the purpose of the Freedom of Information Act 1982, an office declared by the regulations to be the relevant office in respect of that Commonwealth institution.

The Archives Regulations (Amendment) have been drafted to provide for the delegation of a Minister of the power to sign certificates as to certain exempt records to the persons holding the offices declared on Schedule 1A of proposed Regulation 7A.
