Statutory Rules 1988 No. 256

Archives Regulations (Amendment)

(Issued under the authority of the Minister of State for Administrative Services)

The purpose of amending Regulation 8 of Archives Regulations by inserting subregulation (1A) is to provide for a schedule of charges (Part 1A of Schedule 1) for copies of the Australian National Guide to Archival Material or of any part of the Guide. The greater part of this Guide is new stored in machine-readable format from which computer output is available in the form of either pages of printout or microfiche. The charges, prescribed pursuant to section 66(6) of the Archives Act 1983, are aimed at cost recovery.

For the same reason Part 1 of Schedule 1, which is made pursuant to section 36(2) (b) of the Archives Act, is also amended to provide for increased charges for copies of Commonwealth records made available for public access in accordance with Part V of the Act.

Overview

The Archives Regulations (Amendment) Statutory Rules 1988 No. 256 were enacted to address the need for a structured approach to the charging of copies of the Australian National Guide to Archival Material and other related archival materials. This amendment, issued under the authority of the Minister of State for Administrative Services, was designed to introduce a schedule of charges for these materials to ensure cost recovery, in line with the objectives of the Archives Act 1983. The policy objective underpinning this amendment is to facilitate the efficient management and dissemination of archival information by ensuring that the costs associated with producing and providing access to these materials are appropriately covered. This approach not only aids in the preservation of these important documents but also supports the accessibility of archival resources for research and public use.

Scope and Application

The Archives Regulations (Amendment) Statutory Rules 1988 No. 256, issued under the authority of the Minister of State for Administrative Services, serve to refine the financial structure associated with obtaining copies of archival materials in Australia. The amendment primarily targets Regulation 8 by introducing a new subregulation (1A) to establish a schedule of charges for copies of the Australian National Guide to Archival Material or any part thereof, ensuring that these charges are aligned with the cost recovery principles outlined in section 66(6) of the Archives Act 1983. Additionally, the amendment extends to Part 1 of Schedule 1, which, under section 36(2)(b) of the Archives Act, incorporates increased charges for copies of Commonwealth records that are made available for public access in accordance with Part V of the Act. This amendment applies to any person or entity seeking to obtain copies of these specified archival materials within the Commonwealth of Australia, ensuring a standardised approach to cost recovery across all jurisdictions. No specific exclusions or exemptions are stated within the text, though the application of these charges is subject to the overarching provisions of the Archives Act 1983 and any subordinate instruments that may further define the scope and implementation of these amendments.

Key Provisions

The main operative sections of this amending legislation are focused on establishing a framework for the charging of copies of the Australian National Guide to Archival Material and Commonwealth records. Under the Archives Regulations (Amendment) Statutory Rules 1988 No. 256, Regulation 8 is amended by inserting subregulation (1A) (Regulation 8(1A)) to include a schedule of charges for the Australian National Guide to Archival Material or any part of it, which is now primarily stored in machine-readable format (Schedule 1, Part 1A). Additionally, Part 1 of Schedule 1 is amended pursuant to section 36(2)(b) of the Archives Act 1983 to adjust the charges for copies of Commonwealth records that are made available for public access as outlined in Part V of the Act (Schedule 1, Part 1). These changes are intended to ensure that the costs associated with producing and distributing these materials are recovered. The obligations imposed by these regulations are primarily financial. Entities or individuals seeking copies of the Australian National Guide to Archival Material or Commonwealth records are now required to pay the prescribed charges outlined in the amended regulations. This includes adherence to the new charge schedule detailed in Schedule 1, Part 1A for the Guide and Schedule 1, Part 1 for Commonwealth records. These charges are established to cover the costs involved in producing and distributing these materials, ensuring that the public access to these resources is sustainably managed. Breaching the provisions of these regulations could lead to several consequences. While the specific offences and penalties are not detailed in the explanatory statement, breaches of regulations under the Archives Act 1983 can generally result in penalties for non-compliance. These penalties can vary but typically include fines or other administrative actions deemed necessary to enforce the regulatory requirements. The maximum penalties are not explicitly stated in the explanatory statement, but they would be in line with the provisions of the Archives Act 1983 and any related legislation. Failure to comply with the prescribed charges may also result in legal action to recover costs or to enforce the regulatory framework governing archival materials.
