Overview
The Appropriation (Works and Services) Act (No. 2) 1960-61 was enacted by the Parliament of Australia in 1961 to address the need for additional funding for capital expenditure across various government departments and services for the financial year ending on 30 June 1961. The Act was assented to on 2 June 1961 and came into operation on the same day, authorising the Treasurer to issue £2,955,000 from the Consolidated Revenue Fund to meet the supply granted by Her Majesty for that year. The policy objective of the Act was to ensure that the necessary funds were available to support essential government operations and services, including works and services, as outlined in the Act's Schedule. This allocation was intended to cover expenditures for departments such as the Prime Minister’s Department, Department of External Affairs, and the Department of Civil Aviation, among others.
Scope and Application
The Appropriation (Works and Services) Act (No. 2) 1960-61 applies to the appropriation of funds from the Consolidated Revenue Fund for the financial year ending on 30 June 1961, specifically designated for capital expenditures on additions, new works, and other services. The Act applies to the Commonwealth government departments, including the Prime Minister’s Department, the Department of External Affairs, and other specified entities such as the Commonwealth Scientific and Industrial Research Organisation, as well as business undertakings like the Postmaster-General’s Department and territories such as the Northern Territory and the Australian Capital Territory. The Act authorises the Treasurer to issue the sum of £2,955,000 from the Consolidated Revenue Fund for the purposes outlined in the schedule, which details allocations across various departments and entities. The Act's jurisdictional reach is national, applying to the entire Commonwealth of Australia. The Act does not specify any exclusions, exemptions, or thresholds beyond those detailed in the schedule. Subordinate instruments may extend or restrict the application of the Act as necessary for the implementation of appropriations.
Key Provisions
The Appropriation (Works and Services) Act (No. 2) 1960-61 (section 1) is designed to facilitate the appropriation of a specific sum from the Consolidated Revenue Fund for the fiscal year ending 30th June 1961. Section 2 of the Act stipulates that it comes into operation on the day it receives Royal Assent. The primary operative section, section 3, authorises the Treasurer to issue and apply £2,955,000 from the Consolidated Revenue Fund to cover the supply granted to the Crown for the fiscal year in question. Section 4 of the Act specifies that the sum granted is to be appropriated for the services outlined in the Schedule, effective from 1st July 1960.
The Act imposes specific obligations on the Treasurer, mandating the issuance and application of the appropriated funds towards the purposes outlined in the Schedule. The Schedule details the distribution of the £2,955,000 across various departments and services, including the Prime Minister’s Department, the Department of External Affairs, and others. Each department’s allocation is specified, ensuring that the funds are directed to the intended services for the fiscal year. Additionally, the Act mandates the appropriation of these funds for the purposes set forth, ensuring accountability and proper utilisation of the allocated resources.
In terms of consequences for breach, the Act does not explicitly outline specific offences, penalties, or civil/criminal consequences for non-compliance with its provisions. However, given the nature of the Act, any misuse or misapplication of the appropriated funds could potentially lead to financial mismanagement or other legal repercussions. The Act's focus is primarily on the authorisation and allocation of funds rather than the enforcement mechanisms against misuse. Nonetheless, the integrity of the appropriation process is crucial, and any significant deviation from the prescribed purposes could attract scrutiny and legal consequences under broader financial administration laws.
