Overview

The Appropriation (Works and Services) Act (No. 2) 1954-55 was enacted in 1955 to address the need for additional capital expenditure for various departments and services within the Commonwealth of Australia for the financial year ending 30 June 1955. This Act was introduced by the Parliament of Australia and received Royal Assent on 15 June 1955. It authorises the Treasurer to issue and apply a sum of £2,801,000 from the Consolidated Revenue Fund to cover the additional appropriations required for works, new services, and capital expenditure across multiple government departments and services, including but not limited to the Prime Minister’s Department, Department of the Treasury, Department of the Interior, and Department of Civil Aviation. The primary policy objective of this Act is to ensure the financial resources are adequately allocated to support the operational and infrastructural needs of the Commonwealth government for the specified period.

Scope and Application

The Appropriation (Works and Services) Act (No. 2) 1954-55 pertains to the allocation and application of a specific sum of money from the Consolidated Revenue Fund for the fiscal year ending 30 June 1955, aimed at funding additions, new works, and other services involving capital expenditure. This Act applies to various departments and services within the Commonwealth, including the Prime Minister's Department, Department of the Treasury, Department of the Interior, Department of Works, Department of Civil Aviation, Department of Trade and Customs, Department of Health, Department of Commerce and Agriculture, Department of Social Services, and Department of Shipping and Transport. Additionally, it covers business undertakings such as the Postmaster-General's Department and Broadcasting Services, as well as territories of the Commonwealth like the Northern Territory. The Act provides a detailed breakdown of the appropriated funds, specifying the amounts allocated to each department and service for particular projects and acquisitions, such as the acquisition of sites and buildings, purchase of machinery, and installation of equipment. The Act also includes provisions for the issuance and application of the sum granted, ensuring that the funds are appropriately allocated and utilized as intended.

Key Provisions

The main operative sections of the Appropriation (Works and Services) Act (No. 2) 1954-55 (referred to as the Act) include the issuance and application of a specified sum from the Consolidated Revenue Fund (section 3), the appropriation of the granted sum (section 4), and the details of how this sum is allocated across various departments and services (Schedule). The Act authorises the Treasurer to issue £2,801,000 from the Consolidated Revenue Fund to cover the supply granted for the financial year ending 30 June 1955. The sum is appropriated as of 1 July 1954 for the purposes outlined in the attached Schedule. The Schedule delineates the allocation of funds across various departments, business undertakings, and territories of the Commonwealth. The Act imposes obligations on the Treasurer and relevant departments to ensure the funds are utilised strictly for the purposes outlined in the Schedule. The Treasurer must issue and apply the funds towards the specified supply, while individual departments and services are required to use their allocated funds for the particular works, services, or capital expenditures detailed in the Schedule. Each department must report on the expenditure of their allocated funds in accordance with the Act and relevant financial regulations. Breach of the Act's provisions can result in civil or criminal consequences. For instance, misapplication of funds or failure to adhere to the allocated purposes could lead to legal action, with potential penalties including fines or other civil remedies. The Act does not specify maximum penalties for breaches but refers to general legislative frameworks for such consequences. Adherence to the Act is crucial to avoid financial mismanagement and ensure public funds are used efficiently and effectively for the intended services and works.
