Overview

The Appropriation (Works and Services) Act (No. 2) 1952-53 was enacted by the Commonwealth Parliament to address the need for additional funding for various departments and services for the financial year ending 30 June 1953. The Act authorises the Treasurer to issue and apply from the Consolidated Revenue Fund the sum of £6,433,000 for capital expenditures and services specified in the Schedule. The purpose of the Act is to facilitate the appropriation of these funds for the designated purposes, ensuring that the necessary financial resources are available for the continued operation and development of government services and infrastructure. This legislation was enacted to meet the immediate financial needs of various government departments, including the Departments of the Interior, Civil Aviation, Shipping and Transport, Immigration, and National Development, as well as business undertakings such as the Postmaster-General’s Department and Broadcasting Services, and the territories of the Commonwealth. The policy objective is to provide the required funding to support these entities in carrying out their respective functions and projects for the specified financial year.

Scope and Application

The Appropriation (Works and Services) Act (No. 2) 1952-53 pertains to the appropriation of funds from the Consolidated Revenue Fund for the financial year ending 30 June 1953. This Act applies to various departments and services within the Commonwealth, including the Department of the Interior, the Department of Civil Aviation, the Department of Shipping and Transport, the Department of Immigration, the Department of National Development, the Postmaster-General’s Department, Broadcasting Services, and the Australian Capital Territory. The sum of £6,433,000 is allocated for these entities, with specific amounts designated for capital expenditure on acquisitions, construction, and other services. The Act is operational from the day of Royal Assent, and the funds are deemed to have been appropriated as from 1 July 1952. The Act does not explicitly state any exclusions, exemptions, or thresholds, but it does specify the allocation of funds across different departments and services. The scope and application of the Act are further extended or restricted through subordinate instruments as necessary.

Key Provisions

The Appropriation (Works and Services) Act (No. 2) 1952-53, commencing on the day of Royal Assent (Section 2), authorises the Treasurer to issue and apply from the Consolidated Revenue Fund the sum of £6,433,000 for the financial year ending 30th June 1953 (Section 3). This sum is specifically appropriated for the purposes outlined in the Schedule to the Act, deemed to have been appropriated from 1st July 1952 (Section 4). The Schedule details the allocation of funds across various departments and services. Part 1 of the Schedule allocates £4,683,000 to departments such as the Department of the Interior, the Department of Civil Aviation, the Department of Shipping and Transport, the Department of Immigration, and the Department of National Development, among other things, funding activities like the acquisition of sites and buildings, provision of additional share capital for Qantas Empire Airways Limited, and advances for coal stockpiling. Part 2 allocates £1,500,000 to business undertakings, including the Postmaster-General's Department for telephone exchange services and trunk line services, and Broadcasting Services for buildings, works, fittings, and furniture for technical purposes. Part 3 allocates £250,000 to the Australian Capital Territory for engineering works. The Act imposes several obligations on the entities it governs. For instance, the Department of the Interior must ensure the acquisition of sites and buildings as per the allocated funds. The Department of Civil Aviation is required to provide additional share capital to Qantas Empire Airways Limited. The Department of Shipping and Transport must standardise railway gauges and undertake ship construction activities. The Department of Immigration is tasked with establishing hostels for migrant workers, while the Department of National Development must make advances for coal stockpiling. The Postmaster-General's Department must enhance telephone exchange services and trunk line services, and the Broadcasting Services must procure buildings, works, fittings, and furniture for technical purposes. The Department of Works, under the Department of the Interior, must oversee the engineering works in the Australian Capital Territory. Failure to comply with the provisions of this Act could result in various consequences. Although the Act itself does not explicitly state the penalties for non-compliance, breaches of appropriation laws generally could lead to both civil and criminal consequences under other related legislation. Civil penalties may include fines or restitution, while criminal penalties could involve imprisonment, depending on the severity of the breach and the specific laws applicable. The maximum penalties would be determined by the relevant legislation governing financial misconduct and appropriation misuse within the Australian legal framework.
