Overview

The Appropriation (Works and Services) Act (No. 2) 1949-50 was enacted by the Commonwealth Parliament to facilitate the appropriation of an additional sum from the Consolidated Revenue Fund for the financial year ending 30 June 1950. This Act addresses the need to allocate funds for various government departments and services, particularly for capital expenditure on new works and services. The policy objective of the Act is to ensure that the necessary financial resources are available for the continuation and expansion of public services and infrastructure projects across different government sectors, including Works and Housing, Defence, and business undertakings such as the Postmaster-General's Department. This appropriation was deemed necessary to support the government's commitment to public service delivery and infrastructure development during the specified financial year.

Scope and Application

The Appropriation (Works and Services) Act (No. 2) 1949-50 applies to the Commonwealth of Australia and authorises the Treasurer to issue and apply an additional sum of Eleven million pounds from the Consolidated Revenue Fund for the financial year ending 30 June 1950. This appropriation is intended for specific purposes as detailed in the Act's schedule, which includes allocations to various government departments and services, such as the Department of Works and Housing, Department of Commerce and Agriculture, Department of Fuel, Shipping and Transport, Department of Immigration, and Defence Services, as well as the Postmaster-General's Department, which is a business undertaking. The Act’s appropriation covers a range of activities including works, housing, defence research, and communication services. The Act does not explicitly state any exclusions or exemptions, and its scope is confined to the specified allocations within the financial year mentioned. The Act extends its application through the detailed schedule which specifies the distribution of the appropriated funds across various government departments and services.

Key Provisions

The Appropriation (Works and Services) Act (No. 2) 1949-50 (sections 1-4) provides for the appropriation of an additional sum from the Consolidated Revenue Fund for the financial year ending June 30, 1950, specifically for capital expenditure on additions, new works, and services. The Act authorises the Treasurer to issue £11,000,000 from the Consolidated Revenue Fund to meet this supply (section 3). The sum is appropriated for the purposes outlined in the Schedule to the Act, which became effective from July 1, 1949 (section 4). The Schedule details allocations to various departments and services, including £4,600,000 to the Department of Works and Housing, £400,000 to the Department of Commerce and Agriculture, £2,000,000 to the Department of Fuel, Shipping and Transport, £600,000 to the Department of Immigration, £300,000 to Defence Services, and £3,100,000 to the Postmaster-General's Department. This Act imposes specific obligations on the Treasurer and relevant departments to ensure the appropriated funds are used in accordance with the allocations specified in the Schedule. The Treasurer is responsible for issuing the funds from the Consolidated Revenue Fund and applying them towards the approved purposes (section 3). The departments and services must ensure that the allocated funds are spent for the specific purposes outlined, such as the acquisition of sites and buildings, development of infrastructure, and other capital expenditures as detailed in the Schedule. The Act also mandates that any expenditure must be in compliance with existing legislation governing the respective departments and services. Breaches of the provisions of this Act may result in legal consequences. While the Act does not explicitly detail specific offences or penalties, non-compliance with the appropriation and expenditure requirements could potentially lead to financial mismanagement and accountability issues. In such cases, the responsible officers or departments could face legal scrutiny, including potential civil or criminal liability under other applicable legislation, such as the Public Governance, Performance and Accountability Act 2013 (Cth), depending on the nature and extent of the breach. Additionally, any misappropriation or unauthorised use of the funds could result in financial penalties or reimbursement requirements under the relevant financial administration and accountability laws.
