Overview
The Appropriation (Works and Services) Act 1961–62 was enacted to allocate funds for the service year ending on 30 June 1962, specifically for additions, new works, and other services involving capital expenditure. Enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, the Act received Royal Assent on 24 October 1961. It provides authority for the Treasurer to issue and apply funds from the Consolidated Revenue Fund, totaling £91,250,000 under this Act and £54,988,000 under the Supply (Works and Services) Act 1961–62, summing to £146,238,000. These funds are designated for specific purposes and services outlined in the schedules to the Act, ensuring that the supply granted to Her Majesty is appropriately allocated and applied starting from 1 July 1961.
Scope and Application
The Appropriation (Works and Services) Act 1961–62 applies to the Commonwealth of Australia and authorises the appropriation of funds for the financial year ending 30 June 1962. The Act empowers the Treasurer to issue and apply the sum of £91,250,000 from the Consolidated Revenue Fund to supplement the supply granted by Parliament for the specified financial year. The Act appropriates the total sum of £146,238,000, which includes funds granted under both the Supply (Works and Services) Act 1961–62 and this Act, towards making good the supply granted to Her Majesty for the service of the year ending 30 June 1962. The appropriation is designated for purposes and services detailed in the Second Schedule, which includes allocations for departments and services, business undertakings, and territories of the Commonwealth. The Act does not explicitly state any exclusions, exemptions, or thresholds, nor does it extend or restrict application through subordinate instruments. The Act came into operation on the day of Royal Assent.
Key Provisions
The Appropriation (Works and Services) Act 1961–62 (section 3) authorises the Treasurer to issue and apply from the Consolidated Revenue Fund the sum of Ninety-one million two hundred and fifty thousand pounds for the year ending on the thirtieth day of June, One thousand nine hundred and sixty-two. This sum is designated for making good the supply granted to Her Majesty for the specified financial year. The Act further specifies, under section 4, that the total sum granted by the Supply (Works and Services) Act 1961–62 and this Act, amounting to One hundred and forty-six million two hundred and thirty-eight thousand pounds, is appropriated for various purposes and services outlined in the Second Schedule. These purposes include additions, new works, and other services involving capital expenditure for the financial year ending on the thirtieth day of June, One thousand nine hundred and sixty-two.
The Act imposes obligations on the Treasurer and relevant departments to ensure the appropriated funds are used strictly for the purposes outlined in the Second Schedule. This includes adhering to the budgetary allocations specified for various departments and services, such as Other than Business Undertakings and Territories of the Commonwealth, as well as Business Undertakings and Territories of the Commonwealth. The Treasurer must ensure that the funds are issued and applied appropriately and in accordance with the appropriations detailed in the schedules. Furthermore, the Act mandates that these appropriations are deemed to have been made effective from the first day of July, One thousand nine hundred and sixty-one.
Under the Appropriation (Works and Services) Act 1961–62, any misuse or misappropriation of the funds granted by the Act is subject to legal consequences. While the Act itself does not explicitly state specific offences, penalties, or civil/criminal consequences for breaches, it is governed under the broader framework of Australian public finance legislation. Misuse of public funds can lead to criminal charges under the Public Service Act 1922 or other related statutes, potentially resulting in significant fines and imprisonment. Additionally, civil actions for damages may be pursued against officials who misappropriate funds, further enforcing the importance of compliance with the Act's provisions.
