Overview

The Appropriation (Works and Services) Act 1953-54 was enacted to facilitate the appropriation of funds out of the Consolidated Revenue Fund for the financial year ending 30th June 1954. This Act, assented to on 26th October 1953, was brought into operation by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia. It empowers the Treasurer to issue and apply £62,721,000 for the year’s supply and appropriates £94,998,000 granted by the Parliament for the same financial year towards various services, including Departments, Business Undertakings, and Territories of the Commonwealth. The Act ensures that these funds are allocated effectively for capital expenditure such as additions and new works as outlined in the Second Schedule.

Scope and Application

The Appropriation (Works and Services) Act 1953-54 applies to the appropriation of funds for specific services and capital expenditures for the financial year ending 30 June 1954, as authorised by the Parliament of Australia. The Act facilitates the allocation and application of the sums granted by the Parliament, amounting to £94,998,000, for various purposes and services outlined in the Second Schedule. This includes allocations to different departments and services, business undertakings, and the territories of the Commonwealth. The Act authorises the Treasurer to issue and apply the specified sum from the Consolidated Revenue Fund to cover the appropriations, which are deemed to have been appropriated as from the first day of July 1953. The geographic reach of this Act is national, applying to the Commonwealth of Australia as a whole, and it extends to the allocation of funds across various sectors and territories within Australia. The Act does not specify any exclusions, exemptions, or thresholds within its text, and it is anticipated that further details and specific applications of these funds may be governed by subordinate instruments or regulations.

Key Provisions

The Appropriation (Works and Services) Act 1953-54 (Section 3) allows the Treasurer to issue a specified sum of money, £62,721,000, out of the Consolidated Revenue Fund. This issuance and application of funds are intended for the financial year ending 30 June 1954. The Act also appropriates a total sum of £94,998,000 (Section 4) for various purposes, as detailed in the Second Schedule, which outlines the allocation of funds across different categories including departments and services, business undertakings, and territories of the Commonwealth. This Act imposes several obligations on the parties it governs, primarily centering around the allocation and expenditure of the appropriated funds. The Treasurer is responsible for issuing the funds from the Consolidated Revenue Fund as specified in the Act (Section 3). The allocated funds are to be used strictly for the purposes outlined in the Second Schedule, which includes categories such as departments and services, business undertakings, and territories of the Commonwealth (Section 4). The Act also mandates that the expenditure of these funds must align with the appropriations outlined in the Schedules, ensuring that the intended financial obligations for the fiscal year are met. There are potential consequences for non-compliance with the provisions of this Act. While the Act does not explicitly detail offences or penalties for breaches, breaches of appropriation laws generally could result in legal action, including civil penalties. Additionally, misuse of public funds or failure to adhere to the specified appropriations could lead to criminal charges under other relevant legislation, such as the Crimes Act 1914, which could result in fines or imprisonment. The exact penalties would depend on the nature and severity of the breach, as well as the specific laws under which the prosecution is pursued.
