Overview

The Appropriation (Special Expenditure) Act 1964–65 was enacted to address the need for specific funding outside of the ordinary annual services of the Australian Government for the financial year ending 30 June 1965. This Act was passed by the Queen's Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia and received Royal Assent on 3 November 1964. The primary policy objective of the Act is to authorize the appropriation and issuance of funds from the Consolidated Revenue Fund for designated special services and projects, ensuring that these specific expenditures are covered within the financial year. The Act enables the Treasurer to issue and apply the specified sum of £1,368,000 for services outlined in the Second Schedule, which include cattle tick eradication in New South Wales, blood transfusion services, extension services for the dairy industry, and other designated projects across various departments.

Scope and Application

The Appropriation (Special Expenditure) Act 1964–65 provides the legal framework for the allocation of a specific sum of money from the Consolidated Revenue Fund for special expenditures not forming part of the ordinary annual services of the government for the financial year ending 30 June 1965. The Act authorises the Treasurer to issue and apply the sum of £1,368,000 for specified services detailed in the Second Schedule, which includes cattle tick eradication and control in New South Wales, blood transfusion services, extension services for the dairy industry, and flood relief among others. This appropriation is in addition to the funds authorised by the Supply (Special Expenditure) Act 1964–65, bringing the total amount appropriated to £2,368,000. The Act applies to the Commonwealth of Australia and specifies the allocation of funds across various government departments, ensuring that these special expenditures are legally sanctioned and appropriately accounted for within the fiscal framework of the government.

Key Provisions

The Appropriation (Special Expenditure) Act 1964–65 (sections 3 and 4) authorises the issuance of funds from the Consolidated Revenue Fund for specified services that are not part of the ordinary annual services of the Government for the financial year ending on June 30, 1965. The Act permits the Treasurer to issue and apply a total of £1,368,000 for the services outlined in the Second Schedule. Additionally, the Act appropriates £2,368,000 for the financial year that began on July 1, 1964, as detailed in the First Schedule. The Act imposes specific obligations on the Treasurer to ensure that the funds are issued and applied in accordance with the services detailed in the Second Schedule. This includes ensuring that the funds are allocated to the Department of Health for cattle tick eradication and control in New South Wales, blood transfusion services, and other services, to the Department of Primary Industry for dairy industry extension services, expansion of agricultural advisory services, and barley research, among others. It also mandates that the funds be used by the Prime Minister's Department for flood relief in New South Wales, by the Department of Shipping and Transport for road safety promotion and highway maintenance, and by the Department of Social Services for housekeeper services, among other specified purposes. The Department of the Treasury is authorised to make advances and provide funds for services that will be detailed later or pending the issue of a specific warrant by the Governor-General. For breaches of the provisions set out in the Act, there are potential civil or criminal consequences, although the Act itself does not specify these penalties. Typically, unauthorised expenditure or misapplication of funds can lead to legal action under relevant financial administration and public sector legislation, potentially resulting in penalties or other legal consequences. The exact nature and severity of these penalties would depend on the specific breach and the applicable laws at the time of the offence.
